Is there a statute of limitations in NY for unpaid fines?
My friend received a driver license suspension notice in the mail. He went to Town Court to find out why. Apparently this is from 2001. He got a DWI, was on probation, failed to pay his fine, spent weekends in jail. They revoked his license back then. He got license back in 2005. Why was this not found back then? He would not have been let off probation without paying his fine. He has nothing to prove he paid it back then. Should he speak with a lawyer?
Greetings: There is no statute of limitations. Your friend should consider speaking with a lawyer. I would start...
NYS DWI Probation and Ignition Interlock Requirement
Arrest for misd ADWi/DWI per se. No priors in 5 years (hence misdemeanor). Probation orders indicate "If Court and Probation give permission to drive, the interlock must be installed on vehicles owned or operated". Further in Probation Orders are "Conditions of Ignition Interlock". Is it correct to interpret the orders that the interlock is required ONLY if they Court and Probation give the defendant permission to drive? His license is revoked and he received a notice from NYS DMV he is not eligible for a Conditional License so neither can legally give permission. Both are trying to say if defendant doesn't get IID installed on 3 vehicles in the household (none owned by him), he is in violation (already served max jail sentence of 1 year). Is he in violation? What may happen if so?
I believe that interlock is statutorily required if you are convicted of dui.
Can someone retract a guilty plea after being convicted of a dwi
my ex-girlfriend was found guilty of a dwi there were witnesses that testified that she was driving she went to classes and I paid all the fines and she got her license back she now has gotten a second dwi 2 years later she wants me to go to court and say that I was driving for her 1st one she said that her lawyer said it would help her what would happen to me if I did this
I suggest that your girlfriend retain a new attorney.
DWI Arraignment NY State
If on my first Court appearance for DWI in New York State-(1st time offence ever) I request Assigned counsel and get approved - You say judge generally arraigns defendant and enters a plea of not guilty automatically even with no counsel avaiable. does this mean I lose my license on first court appearance even if I'm requesting Assigned counsel? Will I need to find ride the minute I leave court?
The judge can suspend without an attorney OR he can adjourn a few days for you to get an attorney. They will generally...
Can you get a DUI almost 4 months after an accident?
My brother was in a very bad car accident. He was in ICU for a month and then he was in TBI therapy for a month, he has been home for about 1.5 months since the accident in September. On Christmas Eve the officer called and said he would be getting charged with a DUI because he had THC present in his system. He has told us he did not smoke that morning before the accident but did within the last couple of days. I have read that if it appears in his system even if he was not impaired he could still be charged. (which is the case but we can not wrap our head around the fact that this is almost 4 months later) How can they go from telling my mom over and over that there was nothing in his system to now this?
Your brother should speak with an experienced criminal defense attorney ASAP for possible representation if in fact he...
How many times can the DAs office postpone motions hearings before a DWI case is tossed out
I was charged with DWI March 17, 2016. I was offered and accepted to have blood work test done but due to some circumstances that was never completed so there is no evidence of my blood alcohol content. My lawyer has filed motions to suppress some Evidence and the DAs office has been postponing it since August 2016 six times now. The last time we were at court the judge told the DA to schedule this and the next time it's postponed he's tossing it out for lack of due process. My question is should it not be tossed out by now?
There is case law that says the failure by the DA to timely comply with a motion schedule is chargable for speedy trial...
How can NY DMV keep my one and only DWI conviction on my drivers abstract after 10 years when that was the limit when I got it
DMV says the rules have changed but wont give me a specific answer. Now I fought and got my license back even fought to get a taxi license and now I cant work cause no one will hire me due to the fact after 10 years and 9 months they wont take it off. MY family is suffering
because DMV is seperate from the court... that's why.
