You need to be looking into retaining an attorney. An experience DUI attorney will obtain discovery and look into what...
Hello, I am a first time offender with a clean record otherwise. About two months ago I was pulled over for not stopping completely at a stop sign. I was carrying a half ounce of marijuana on me. The officer said that he smelled burnt marijuana which got me to admit almost immediately to having smoked recently to driving. The officer asked me to get out of the car and ran me through the typical drunk driver test. He then placed me in the back of his police car, informed me I was being arrested, and that is when I admitted to the possession and handed over the ounce. I was taken to the station, booked, and a pee sample was taken.
Now, two months later, I have a court appointed lawyer, Mr. X, for my serious misdemeanor possession charge and haven't heard anything about my possible (and more than likely) OWI. Mr. X says that, once the OWI surfaces, he'll give me a deal and represent me on both charges. I am looking to seek deferred judgement.
A family lawyer told me that if I take my deferred judgement then it should cover the misdemeanor AND OWI. Why haven't I heard anything about the OWI yet? Why is Mr. X making it sound like it's a completely different thing with its own bill?
Iowa Ethics rules prohibit attorneys from second guessing another attorney when a party is represented. You'll need to...
What would be the best thing to do? Should we fight it?
We got pulled over for a busted headlight the cop comes up to our car says he smells marijuana and we should just give it to him all we had on us was paraphernalia so we did. Told me and my husband to get out of the car they make him do 3-4 sobriety test and even a breathalyzer which came out to be 00.0 and said well your showing signs of being under the influence so we're going to take you in tonight.
You should talk to an Iowa criminal defense lawyer.
