When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.

my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?

I was stopped during a routine stop, no hazardous or unsafe driving of vehicle noted and given 3 separate breathalizer tests on 2 machines. My vehicle was registered and insured. I am mobility impaired with handicap plates on my motorcycyle. I was not told of the results of the breathalizer tests and given the field sobriety tests and was told it was up to the officer to arrest me or not. So he did. He told me, I could have blood drawn and I did. The results came back clean. I had to pay a bondsman to get me out and had to pay again to get another court date. I have plead not guilty and ready How can I get my money back and sue the county for harassment, and false imprisonment and defamation of character. I am a nurse and have had a clean record thus far.

I was using my phone to get a ride home when a police officer pulled up and walked past my car to a unattended vehicle, as he walked by he asked me if i knew who's car it was and i said no and went back to using my phone.The officer returned to my vehicle and said he smelled the presence of alcohol and asked me if i had been drinking and i said no sir then the officer asked if i would do a sobriety test i responded no sir and tried to explain that i was just using my phone nothing more.Then the officer asked if i would submit to a breath test i declined but i said yes to a blood test so i wouldn't lose my license, he told me to exit the vehicle and he arrested me for DUI. I was pulled over for failure to maintain lane at 4:30AM on my birthday (Friday, May 10th) after having waited a couple hours to leave my friend's. I was certain I was ok to drive because I drank very little and much time had passed. I was questioned, and I later agreed to take the breath test at the station believing cooperation would help in the long run. I was not told how I did on the FSTs. I blew a .087 (pretty low, yet high for the amount I drank) and booked at around 5AM. I stayed in jail all of that day and released on bond Saturday afternoon about 33+ hours later. Could there have been a mistake on the breathalyzer? I did vomit before I left because of food poisoning, and I was told that could've affected the reading.

The arresting officer checked the first two spaces on the DA - 1205 form , indicating that I had tested positive above 0 . 08 . Considering that the form clearly states " MARK ONE ONLY " and on his sworn report , he is indicating that I tested above 0 . 08 , which cannot be proven because I refused to take a Breathalyzer , will this help me ? ? My license has been suspended for 1 year, but according to the new law I am eligible for an ignition interlock permit after 120 days of hard suspension. I went to rehab for 6 months, I did the DUI school, I did the evaluation, I paid my fines. I can't afford an attorney just to go in front of the judge to ask for a certificate for interlock device.
