I've had 2 DUI's in a 7mth period. I've done all that was required of me to do and now 7yrs. later, I can't afford to get the
breathing device on a vehicle. I'm disabled and don't have a car. I'm trying to get my license back so I can get to my doctor's appointments by borrowing my sister's car and not having to depend on her trying to get off work to take me . What can I do to not have to pay for the breathing machine that I can't afford?
You can file a motion to waive the ignition interlock device, but you have a much better chance of success with a...
What is the statute of limitations for a dui that happened in 1999?
I was convicted of a dui in TN in 1999 with a 0.3 BAC, I was arrested in a dry county. I paid all my fines and completed my community service within the time specified. I was and still am in the US Army. After I completed my requirements i was deployed to Korea for the next year. 2 Months ago I got a letter stating that I would have a warrant for my arrest if I did not contact the sheriffs office. Upon doing so they told me that i did not contact my probation officer like I was told to and they have not been able to contact me until now (even though I am still in the Army). They want me to complete another 40 hours of community service and pay a court fee. Because this was 14 years ago I no longer have the records to prove myself. Can they do this or should I try to fight it?
I advise that you direct this to TN criminal defense attorneys. Notwithstanding, based on your facts, you may be able...
I was told by an attourney not to take a subriority test. After taking and not failing , but doing poorly on the roadside test,
Finding no alcohol or drugs, I was arrested for DUI drugs. The reason I did poor is due to my previously broken femur bone. My miranda rights were not read and no one informed me that by refusing to give urine aren't blood, that I would lose my liscense for a year. I aslo was not informed that I have 10 days to get a permit to drive to and from work and appointments. I was incarcerated for 11 days and missed that grace period. My wife has a brain tumor n seizures, plus I have a 4 yr old that we can't get to pre school. So far, I have not been indited yet and nobody seems to be able to help me with my liscense or tell me what is going on. What are my options? I lost my job and my wife can't drive due to her seizure disorder.
If you were incarcerated for 11 days, that should justify the delay in sending the ALS hearing request. Get an attorney...
What information is required in a hearing request for my driver's license?
When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.
It appears you are working with the DDS provided form. You are not required to give the facts requested. My advise is...
Why are the officers and the system in general harder on individuals who refuse Dui tests
my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?
The legislature decided many years back to enforce a harsher license suspension for people who refuse to submit to a...
Do I need to wait out NC's 1 year DWI suspension to get my license back? or do I only have to complete GA's 120 day suspension?
Georgia resident with a DWI conviction in NC. NC DWI conviction requires a mandatory 1 year suspension. However, I have a GA license and I think I would qualify for GA's 120 day reinstatement provided I complete the necessary requirements for reinstatement.
I've always said that it doesn't hurt to try.
Will this be enough to prove there was no probable cause to pull me over?
I was arrested for DUI in Atlanta GA about 1 1/2 years ago. I am now about to go to the hearing in a week and have received my arrest video. In the arrest video, everything looks standard protocol. But, when the DUI officer arrives on the scene, the officer that pulled me over begins chatting with the DUI officer. The officer that pulled me over says, "John... John, I pulled him over for a traffic citation, wanna know ... wanna know why I really pulled him over? I saw him look back at me in his rear mirror when i was behind him... i wanted to get him." they then went on and on about how to secure a dui conviction, and how to make a jury no feel guilty for me, and how you don't want to lose an arrest etc etc. This sounds crazy to me. HELP
Wow, this is great evidence for your case. You need to speak to your lawyer about this, although I imagine he or she...
