Can they run a drug test if I only have an etg test?
Greetings all, please don't worry. This question is for knowledge's sake only. My question is would they run a drug test even if only an etg test is scheduled for today? How will they notify me that a drug test is scheduled for the person if the sentence is only for etg. I'm just worried for a friend who smoked marijuana 2 days ago and has an etg test today. (Yes, I do know people on probation should not indulge) Here's his case: he was scheduled for a first drug test, given the color for it and a number for etg. He passed the drug test, they said only hear for the number (etg) and no color and so he is only tested for etg now. Can they run a drug test on him? How will he be notified? Will they notify him before?
The court only requires repeat drug tests when the first test contains some positive result or when drugs part of the...
Field Sobriety Tests in Michigan
I am not in trouble for drinking and driving. This was an information question only. Are you required to submit to field sobriety tests in Michigan ? Is there a penalty for refusing? I was always told to never answer questions without a lawyer present and I personally consider a Field Sobriety Test the same as answering questions but I dont want to get myself in trouble if it ever happens and I refuse. Thanks for taking the time to respond.
Once you are arrested, the officer should tell you that if you choose to take a test, then you also have the right to...
Failed Interlock Ignition Test
I was recently granted a restricted license in the state of Michigan due to having 2 prior DUI convictions. The other day I was running late for work and had embarrassingly ran out of tooth paste. I mistakenly used some mouthwash and immediately tried to start my car. I failed the start-up test and was running late so I simply dispatched an Uber. Later on that day on my lunch break I went an took a ETG Dip card test which was negative for alcohol (I haven't consumed alcohol in over 2 years). I have to take my car in because of the violation and they are going to report it to the state of Michigan. Is there any chance for me to retain my restricted license with these circumstances?
You should go back to the attorney who assisted you in getting this far. That attorney will know your full background....

Talk to your pretrial release officer about whether you were to be given a pass for a positive initial result. You...
Did I violate my probation and what will happen now? DUI Rochester
I was convicted by a jury of DUI. I am one month into a year of probation. In lieu of JAMS testing, I have an interlock device from smart start and I'm required to blow between 8am and 9am every morning, which I've done without issue. However, this morning my key fob malfunctioned and I could not unlock my car (it's a new higher end car with no actual key). I went to the dealer (my wife drove me in her car) at 8:30am, they reprogrammed the key, but that didn't work. So we had to go to the Troy Motor Mall and get a new key fob, which had to be programmed as well. Got back to my car at 10:10, unlocked my car and submitted a successful clean test. I have the paperwork from the dealer and the phone calls, etc. I figured it was no big deal but several coworkers are telling me that 52-3 probation office will definitely violate me for being an hour late on the test, and that I will probably go jail or get WAMM weekends and fines, etc. Is this true? I don't think I did anything wrong at all and I did everything I could (short of smashing my own window) and I haven't drank a drop of alcohol. But I'm hearing none of that matters, I'm screwed...
Your should call your attorney about this. I would recommend documenting your efforts, and seeking a EGT test asap....
What to do? My mom convicted of DUI after accident on ice; doesn't understand she's been convicted. Court-appointed lawyer
Last winter, we were hit with an ice storm here in Michigan. My mom was on her way home from the grocery store beginning of the storm (3pm), hit a patch of ice and slid off the road and into a very small tree, at a low speed. There was no damage to anything except her OLD car, which the insurance company totaled (it was too old). However, the police decided to arrest her because he asked her if she had anything to drink. Of course she hadn't, but she had taken a Norco, as prescribed by her doctor. My mother has a previously broken back, so shopping is hard for her. Drug test came back - she had nanograms of Norco in her system, along with nanograms of Xanax from the previous night, which she also has a prescription for. My dad has been taking her to court, but now they are talking to me about probation! I asked if she was convicted of a DUI and both say "I don't know what happened". Neither seem to know what the judge did!!! Is this normal to get a DUI for small traces of Norco and Xanax in your blood, even with a script? And is it malpractice by the court-appointed attorney? They don't know what's going on! No previous criminal history. Thank you!
There is nowhere near enough information in your question to give you a complete response. You first need to know if...
Is this a lawsuit?
in 2006 I was pulled over and given a DUI, later in court I was charged with an MIP. In 2012 I was charged with DUI 2nd offense. I contacted the SOS and they informed me the court house did not send the proper paperwork for the 2006 charge and they still had DUI recorded. Since I got the 2012 charge I have not had a license. I figured out today it is all because of the court not sending the proper paper work. Is this a lawsuit against the courthouse? I have missed out on jobs and spent tons of money on public transportation and also paid the drivers responbility fee for the 2006 charge which should have never been paid.
Even if you had a case before, you are probably way beyond the Statute of Limitations which would have started in 2012...
