Probation Violation
I am on KAP probation for 2 years for driving without insurance. It is a 2nd offense. I just got 2 more charges. One for TBUT<500 and unlawful transaction with a minor. Would this be a probation violation? And am I looking at 30 days jail time which was probated on the insurance case? This is the 1st time Ive ever had anything other than the insurance.
In Maryland, where I practice, Standard Rule 4 of Probation is, "Obey all laws." No daubt, KY has something similar....

I was arrested for a DUI 3rd offense within a short period of time. However, my first two DUIs are both technically 1st offenses...that is how they were both prosecuted. After the second first, I didn't receive a SCRAM. In this event, I was passed out in the car with the car running and in park. No movement at all. I was parked in a private parking lot down the street from my house. The owner of the establishment called an EMT and I was taken to the hospital with a high BAC and didn't receive a copy of my DUI citation. I've since completed a stint in alcohol rehabilitation. This was many months ago, and I didn't know I had charges against me until recently. I am scared to death at the possibility of a guilty verdict for DUI 3rd. Any help or advice would be much appreciated.
the best thing you can do is hire a very good attorney and enter an AA or other rehab program immediately.

After getting a DUI in CA and now living out of state, how can I get my BAC lowered for a 1650 waiver?
I received a DUI in 2013, started my program in Mar, 2014 but was dropped (8/4/14) for missing too many classes and failure to pay. I have been working on this from KY all year with no success. I had a warrant, got it recalled, have had my SR22 for 7 months, applied for a 1650 waiver but was denied because my BAC was a .22 and the MAU says this prohibits me from being eligible without an amended abstract lowering it below a .20. DMV gave me 3 options, to get it lowered, to re-enroll/drop and pay some fines, and to return to CA to finish it entirely. I have a life and a job in KY I can't leave for the amount of time it would require to settle options 2 and 3. I've been without a license for some time and need it back ASAP.
The amended abstract of judgment seems like the best option, but it would be very difficult to get, I think. Imagine...
