Can a person arrested for driving with a CAB above . 08 drive out of state during the temporary receipt period of 45 days ?
With first offense of a DUI in the state of Illinois , and during the first 45 days a person is allowed to drive with the temporary receipt , can the offender drive into a neighboring state and back without a special permit stating the driver can leave the state ? Or , does a person arrested loose their right to drive out of the state all together during the first 45 days ?
Typically, your bond sheet will specify that you are not permitted to leave the jurisdiction without court approval.
It seems like it would be better for a person suffering from alcoholism/addiction to get treatment since the prisons have extremely long wait list for substances abuse treatment. But again the prison system is not about rehabilitation rather just punishment-

I recently lost a judgment on a 2nd DUI bench trial, and want to file for an appeal or new trial. Please see below.
There was no breath test. My field sobriety tests were not perfect, but I performed fairly well. During the tests, my contact lenses fell out. I have -7.5+ vision. (Very poor). I was also suffering from a cold and watery eyes that contributed to the lenses falling out. (Have prescription records to prove that). I also stepped on a rock, and I brought that to the attention of cop. During the video portion of the stop, my driving is perfect. For some reason, the judge believed what happened before and after the video than what he saw on the video. During the final deliberation of judgment, the judge remarked if I can see a rock, then my vision was not an issue. He acted as a judge and medical expert. Medical records were not summoned. Do I have ground to ask for appeal / or new trial ?
