Will my public drunkenness turn into DUI?
I went to court for a DUI and had been drinking the night before. I still smelled apparently but I wasn't acting belligerent in any way. I agreed to a breathalyzer and didn't expect to have much in my system, but it was enough that the officer made an arrest. Later I found I was charged with public drunkenness, but the officer said I was lucky to not get charged with DUI as they had no video evidence of me driving. Is it possible the prosecutor still upgrades this to a DUI? Besides that, since I wasn't belligerent, can I get the public drunkenness dropped? I don't believe I was in an altered state, I just blew too high. Since that incident, I have lived completely sober as well. I learned my lesson.

Can I get a probation drug screen thrown out or a retest for improper testing procedures?
I got tested at probation, but could hardly pee so I didn't have much in the cup at all. The probation officer then tested it with an immunoassay test and said I tested positive for marijuana. I told him it was impossible, and for some reason I never signed off on anything, never saw it transferred to the next vial, never labelled it and didn't even pay for the test. I'm wondering if I can get this test thrown out because the procedure was all wrong, and if I could retest? Any advice is appreciated.

How will a public drunkenness charge affect a pending DUI case?
I had a few drinks the night before I went to the calendar call for a pending DUI charge. The smell of alcohol was still on me the next day. So, when I went to court, they arrested me for public drunkenness due to the smell of alcohol. I was not drunk, so I plan to fight that charge. However, I worry that the charge will affect my DUI charge, which I am pleading guilty to. My next court hearing is in a week.
It doesn't help, but a good defense lawyer will be able to deal with it.

I was given an MIP in North GA in a dorm room. I wasn't drinking and the one bottle was completely sealed and unopened. I wasn't tested with a breathalyzer because I hadn't drank any. The other night I had a few glasses over a period of several hours. An hour or two after my last glass I was hungry so I went to a drive-thru. I honestly didn't even consider the wine because I felt completely sober. On the way back my tire popped so I put on my hazard lights and pulled off the road. There was a car directly behind me and it was really late so it made me uncomfortable. I got back on the road for a split second before I saw the lights and realized the car was a cop. He asked if I'd been drinking and I answered honestly. I felt that I did fine on the field tests but blew a .112. When I arrived at the jail I blew a .116.
