I was never read an implied consent advisory or given the option to refuse the taking of my blood after I was arrested for a DWI. Instead, a search warrant was issued that allowed for the taking of my blood, and they took it (without me having any say in it)? Is this legal? I was arrested in Saint Louis Park MN for DWI and blew a .13. This is my first offense. I am a high school teacher and do not work in the Saint Louis Park distirict or in Hennepin county. Car was impounded and plates were removed before I picked it up the next day. I did not have to go to jail that night. Blew .20. Trying to figure out what I will have to do when court comes. I don't have a ton of money and have talked to a few lawyers. Everyone says I just need a public defender. I am trying to possibly get it reduced to a misdemeanor vs. gross. If I am on probation and was drunk in a car with a driver that was arrested for DUI, but I was let go.. Will probation find out?
I am on probation for DUI and am not allowed to drink. Their was an open bottle in the car, which I admitted was not mine, but I had been drinking. The cop took my information and released me with no charges filed. I am required to report any police contact. I am worried if I tell my PO, he will look deeper into it and read the police report, which will be quite apparent that I had been drinking. Am I better off to keep quiet? What are the chances he finds out on his own? I was just recently given a longer leash with probation. I don't want to mess that up if I don't have to. I may be in just as much trouble if I come clean as I will be if they find out on their own. Should I just take my chances?

My friend was arrested for DWI and I am not sure on this part, but he either has a green card or does not have any papers.
He has gone to every court date and has been going to all of his DWI and AA classes and also has not been drinking and has passed every drug/alcohol test. This week the friend who bailed him out of jail got the letter in the mail that he missed court earlier in the week and he is to be handed over to ICE. My friend did not know he had court because his lawyer never called him to let him know. He then called his lawyer who told him he will no longer be able to help him (or is unwillingly to help him). Can his lawyer do this? Isn't it his lawyers fault for not telling him of his court date? Is this malpractice?

My buddy got his second dui in march 2009 and blew an .084, he just got sentenced in 2013 and now has the car breath alyzer. Shouldn't he have had the same laws in 2009 than the new laws? How long does Minnesota have to convict or sentence anyone?
