My husband and his friend Bob were injured in an auto accident while they were drunk and it was a terrible accident. Neither can remember what happened but they ruled Bob as the driver on the accident report and the first arriving witnesses said they seen my husband emerge from the passenger window. Now Bob is trying to sue us after having failed suing out auto insurance who wont cover Bob because he was driving. Bobs lawyers are now claiming that my husband was driving when all the evidence points otherwise. Does Bob have a legit claim? Can we counter sue for the same thing hes trying to sue us for? On our way from NJ to WV i got tired of driving so i let my boyfriend drive who hasnt had a license in 11 years and the reason for it is he got a dui , lost his license, and never got it back but can if he wanted to. I was convicted of my first DUI two years ago in which I blew the minimum limit .097. I attended the 6 week drug and alcohol class a year ago. I did not have the interlock system installed in my car. Is this the reason for which I am being summoned? Because I was under the impression that I did not have to have the interlock given the circumstances of the situation.

I got charged with first offense DUI September 2011. The judge did not accept a plea upon me voluntarily entering the interlock program. In March of 2012, i was caught driving with expired registration and charged with my second DUI because of my revoked status. DMV sent me no notification of my license being suspended or my registration needed renewed. The court of the Second DUI now has jurisdiction over everything, but they have yet to set a date for me to appear. After march, can i request for the case to be dismissed, take my classes, pay my fines and get the charges dropped and my license back?
