Attorney Violates Code Of Ethics, No Legal Repurcussions?
If an licensed attorney violates the Code of Professional Responsibility, and as the result of this, they influenced a case. According the the OSBA, this could lead to infractions or disciplinary hearings involving the lawyer, where they can be sanctioned, or have there law license suspended. However, it also states that whatever the results of there investigation, it will NOT affect a case. How is this so? If an attorney willfully does something they are not supposed to do, and they directly had an impact on the case, why can't the disciplinary process recommend actions to take place on the case, instead of bringing an Appeal to the State Courts? We are dealing in 2 areas here, one is that the lawyer has to abide by there code of ethics, and two, as a result of this, no common legal error can be asserted in state courts. This makes absolutely no sense at all.
If an attorney violated the Code of Ethics make a complaint to the local bar. If it affected your case then speak to...
What should I expect for my second offense OVI probation in Columbus OH
I was recently convicted with two OVIs within a few months of each other. I just got the hearing results for the second one in Wadsworth and I was put on probation in that city for a year following the offense. I am not required to physically report to them since I live 2 hours away in Columbus; however, I am required to report to my Columbus PO and have an interlock device installed. This isn't a set schedule as of now and it ends in June. My question is if I was not charged for any drug offenses, would I be subject to a drug test in addition to the alcohol test or would I just be subject to the alcohol test?
It is common practice the during any term of probation in Ohio that the probationer is prohibited from using alcohol...
Should I expect to be contacted by the authorities for DUI suspicion?
I was driving home from a wedding and road conditions were bad. My vehicle slid off the road after hitting a patch of ice. There was no major property damage (nothing was hit in the accident and the only "damage" was the tire tracks and ruts left in the ditch). The tire tracks were as deep as 6 inches in spots where I had tried to get the vehicle out and they ran about 20-30ft. There was standing water due to there being so much drainage. I stayed with the vehicle for up to an hour and called in to AAA who told me the tow truck would not be able to make it until the next morning. Due to temperatures being below freezing, I left the scene and taxi'd home. A witness did stop and ask if I needed assistance but I don't know if they called the accident in. At this point I was frantic and seemed panicked. I did not call the accident in to police. At the wedding I had done some drinking (3 drinks over the course of 2 hours). I retrieved the car the next day with the help of AAA and have not heard from police. There was no damage to the car, myself, anyone else, or any signage. Would they be able to contact me for suspicion of DUI? There were no tickets on the vehicle the next day.
Either way, best not to make any statements without representation
If I was put on probation in Georgia but I do not live there how am I suppose to comply?
I was pulled over in Georgia for driving on a suspended license on my way back from Flordia. I served 10 days in jail in Georgia. The judge said I did not have to appear in person to the probation officer since I do not live there I just had to call the day I got out. I called and left a voicemail the day I got out and never heard anything until yesterday. I got a letter saying I failed to appear and that I have to appear in person in less than a week. I cannot get back to Georgia in that time. I have traveled there and back three times now and missed out on two jobs because of this. what do can I do?
You get an attorney in GA. That is the best thing to do.
Can I apply citizenship after I live 5 years in America. But I got minor OVI .. I am very very afraid I can't get approved.
I get OVI on 3-4 months ago.. I been 48 hours in jail. But I didn't get any suspense for my driver license.
If you have nothing else disqualifying you for citizenship with the next 5 years, this OVI conviction will not prevent...
If my blood was taken at the ER following an MVA, for medical reasons, afterI told the nurse not to, are those tests admissible?
I was In an MVA, and I was transported by ambulance to the hospital, I was given morphine and ultimately treated for a head injury (airbags). During that time the cops were waiving papers in my face and yelling while I was in and out of consciousness, and ultimately charged me with refusal. Papers said they smelled alcohol (I had 3 beers earlier and I'm a 240lb male), I had glassy blooodshot eyes and was unsteady on my feet, and listed on the 2 forms that I was "unable to sign". Later the nurse was going to draw blood for blood work, I told her I dont want her to, she said it's for testing to see if your kidneys are failing, not for the police, and took blood anyway. This would be my 3rd OVI, I've contacted an attorney who I believe will do a good job, but just wanted to get as much info and thoughts as I can because I'm obviously freaked out as I feel like I'm getting railroaded by the cops because of my record!
Arguably NO. There is a recent SC decision that held warrantless, nonconsensual blood draws are inadmissible. OH has...
Is a dui a violation of felony drug poession intervention in lieu of conviction?
Got a dui the other day, one of my conditions is not to drink alcohol or get a new charge, but it's not a like charge and I didn't have alcohol or drugs on me. I'm on parole and have been respectful and compliant with my parole officer
Yes, it is likely a violation. You should inform your P.O. immediately.
