When will I find out my charges?
I was in an accident totalling my vehicle. I was in the hospital overnight. They did blood tests , my bac was over the legal limit. I am in the care of my family at their home . How will I be contacted , will I receive a summons? I am not at my home because of my injuries, will a warrant be issued ? Should I call the highway patrol?
If there are charges or a traffic citation against you, you should be able to find it online or by contacting the clerk...
Is it ok to travel now or do I need to compete any paperwork? If I need to have paperwork done, what type of lawyer can help?
Had a dui in Ohio in 2001 and need to travel to Canada.
I believe you need to complete a process called criminal rehabilitation. I have sent my clients to a Canadian attorney...
DUI "Administrative Processing" how long does it typically take for FBI clearance (i am currently in Mexico city) ?
Hi, I am currently in the process of visa stamping in Mexico City. I have a DUI from 2014, and I've completed all things ordered by the court. The case was closed (not expunged) in June 2015. I attended my Visa interview on April 4th 2016, completed and submitted the Panel physician as directed by the consulate on April 4th 2016. and i am still waiting on any update from the consulate and is still in "Administrative Processing" showing last update as April 4th 2016. I am assuming they are going through FBI clearance right now. Could you please let me know how long this process might take ? It has been 1 month now since the submission of the reports by the Panel Physician. Please Advise. Thanks.
Weeks to several months or more. There is no set time frame.
How can I avoid jail for second OVI offense?
Picked up for second Dui, last dui was 5 years ago ( I was 21 ). Blew first time did not blow second. The case has been drawn out for over 5 months ( lawyer had surgery and I was just kind of in limbo waiting from that ) and I am now currently pregnant ( found out about 2 weeks after being pulled over ). I lost my job and have been unable to get another being pregnant and not being able to drive. I have not gotten in trouble since the offense or have any records prior to that. I have not spoke to my lawyer since December, I have considered getting another lawyer because the stress has caused some issues in my pregnancy. I have no issues with probation or house arrest but going to jail is just not an option. I have history of bipolar and have been unmedicated since being pregnant and will not resume until I give birth and having never been to jail I'm not sure how I'll handle it.
To avoid any jail, you have to avoid a 2nd in 6 OVI conviction. If you are convicted of a 2nd in six, 10 days jail or 5...
Can I press charges against a drunk driver who rear ended me on my motorcycle?
I was riding my motorcycle home and was rear ended by a drunk driver. My bike is still partially running but I need to go to the hospital and get checked out. The medics came to the scene and I was standing and told them I just have some pain in by back and neck as well as my left appendages. I'm wondering if I can press charges against the person who hit me for damages?
You can sue for your damages and should find local personal injury counsel who will accept your case on contingency basis.
Do you think I should take the deal from DUI to physical control?
I am an international student in Cleveland I was convicted with DUI on January 1st in Columbus so after the 2nd court trail we have a deal of 'physical control' and three day class for non alcoholic related, we kept the deal on table and trying the jury trail on March 26th so do you think I need to take the deal or fight back till it goes off record. I want to know in a long run if I want to change my visa From F1 to H1 in future would affect it or in my employement.
I cannot speak to the immigration issues. It sounds like you may have an attorney for the DUI. That is the attorney...
Ex has a felony (DUI) and a gun, is that enough to get him prosecuted after his threats of custody?
Currently going through a divorce. My soon to be ex has a Felony from 4 DUI's. He also has a gun. I was under the impression Felons were under a disability and were not allowed to have access to a gun, nor own one. (My attorney advised me to call the Sheriff) I called the Sheriff and they are requesting I call the attorney general’s office. They are unsure. A little back story: He has been threatening me. I know he has a gun and has been abusive in the past. (Not with the gun but you never know as this is a custody battle divorce) According to ORC §2923.13, no person shall knowingly acquire, have, carry, or use any firearm or dangerous ordnance, if any of the following apply: • The person is a fugitive from justice; • The person is drug dependent or a chronic alcoholic; • The person is under adjudication of mental incompetence or has been found by a court to be mentally ill; or • The person is under indictment for or has been convicted of any felony offense of violence or the illegal possession, use, sale, administration, distribution, or trafficking in any drug of abuse. So my question is: Is it legal for him to own a gun if he has a Felony
It seems like you are trying to get your ex prosecuted to gain advantage in your divorce. The prosecutor would be the...
