Do I have to hire a lawyer if I know I will get ARD? Can I represent myself and avoid the expenses of a lawyer?
I will be receiving a DUI soon in PA. I am just waiting for my blood test to come back. I spoke with a DUI attorney over the phone and he looked up my record and said that he could get this expunged and I would probably do the ARD program. His fee is reasonable ( $2500 ) I suppose for a lawyer, but I cannot afford it regardless. If I just wait till my court date and get a public defender or represent myself can I still expect the same outcome?
You have the right to represent yourself. A very good trial lawyer (who is famous for other things) was quoted more...
Does the PA police come to your house to give DUI charge papers?
I just recently got a DUI at a checkpoint on memorial day weekend. It was not an underage DUI, i was 22 at the time and my BAC was a .11. So my question is will my first court papers and charges be delievered by mailbox or does the police bring it to me at my house? Also is there a timeframe for when i should expect it to come?
If you had a blood draw it may take a couple months
Can I use a storage unit for my firearms In my situation?
A while back my wife was hit with a DUI(weed) and driving under a suspended license. She will be doing her mandatory 3 days in lock up starting 6/9/17 and then probation for 6 months. I own several firearms and have my LTCF. I know that they can not be in the house until 12/9/17. The only person I trust is over an hour away but the problem is i go to the range every weekend and I hunt so can I store them in a storage unit so she is not in violation. Because taking them to my dads and getting them when i need them puts unwanted wear and tear on my car.
I would say most likely this would be acceptable as long as they are not kept in your house.
Will I be stopped at Immigration after my DUI has been expunged??
I have been charged for DUI in Pennsylvania and I did the ARD program, completed it and expunged it. I do not have a green card and I am planning to go to India. I am on stem OPT. Will there be any issues coming back from India to the USA. Thanks in advance
CBP can still acccess your criminal history after you obtain an expungement. I recommend that you travel with a...
PA resident- PA DL, DUI in Delaware- works in DE, can he get a Work License to drive in DE?
My son got a DUI in Delaware after a night out with friends and going off the road and hitting a tree- he was critically injured -no other people or vehicles involved- and they did pull blood in the hospital- he is 21, a PA resident with a PA license -but works in Delaware and has to drive as part of his job. We have not yet had a hearing as he is still under the care of doctors with a traumatic brain injury and unable to leave. He is expected to have a full recovery in 5-7 months and hopes to return to work as soon as he is able.
You need to retain a DUI attorney in Delaware. He/she will address the case while your son is recovering. When your...
Can I sue this drunk driver? Victim sustained no injury; Vehicle totaled
My husband and daughter were hit by a drunk driver who has been deemed 100% at fault; he has insurance. My family sustained no injuries (thank God). Our insurance company is going to total the vehicle for $7,400. This vehicle was paid off so my family can NOT afford a monthly payment and 7k just won't cover the cost of a vehicle we need. Any suggestions or help in this matter?
In cases of this nature, the damages are typically limited to the market value of the car. It is unfortunate that you...
