Should My Buddy fight his DUI?
The car was pulled over in up-state New york. The State police found less than 1/16 once of marijuana in the vehicle and two glass smoking pieces, both with resin. He admmited to smoking hours earlier. They performed several field sobriety tests and decided he was under the influence of marijuana. After taking us all to the station the police had a specialist come in to determine the level of intoxication. When the "expert" exited the station he informed me and another friend the he belived that we were all to intoxicated to drive. He then told us that there is no way to officialy prove that a person is under the influnce of Marijuana. the police siezed the car till the next morning. At the time, no sobriety check was done on me nor did I admit to smoking marijuana do we have a case?

Conditional license from DMV?
I was recently convicted of DWAI in New York. I also attended a hearing at the DMV because I refused to take the breathalyzer when I was arrested. After the hearing, the DMV took my license away for a year based on my refusal. Can I get a conditional license? The woman judge hearing the case was really mean.

DUI criminal record question..
so last year i plead guilty to DUI and DWAI as a pre-sentence condition. then last week, DWI misdemeanor was dismissed and I plead guilty for DWAI violation and i was placed on a conditional d/c for a year. My question is, will that DUI misdemeanor will appear on my criminal record even i initially plead guilty with DUI misdemeanor and DWAI last year? Thank You!

How Florida deals with out of state revocation of privilege if it is not for DUI or DWI but for 3 speeds in 18 months?
Accordingly to Florida law there is no such thing like revocation for 3 speeding tickets in 18 months period. In my case this will be equal to 12 points in case I loose at all 3 hearings. To my understanding, by Florida law they should simply suspend my license for 30 days because of accumulation of 12 points in one year. Or it doesn’t matter? If your privilege becomes revoked somewhere, they do not care by what reason and revoke your license too? Does anybody know?

My daughter was convicted of a dwi. She got a interlock system put into her car for one year. Three months in.
She tried to start her car in the morning. The night before she had some drinks. Apparently there were still traces of alcohol in her system. So car didn't start. She was charged with a violation . This is her first offense. She is a single mom with a 3 month old baby. Has a good job. This has been going on for over a year. She never had another incident. The judge wants her to serve 10 to 14 days in jail. For violation. She attends aa twice per week. I think this unfair. She will probably lose her job. And it would be tough on baby. If the judge has already made up his mind. What can we do. He said if we go to a hearing she will get at least 30 days. And he decides. We requested weekends in jail so she doesn't lose her job.
