Could I be waiting to get a dui?
Was in a car accident about a month ago, it was my fault. I was taken to the emergency, but had no injuries. The other person was also not injured in any way. They did blood work and found that there was alcohol in my system. About an hr later, an officer came in and only gave me a traffic citation. I am currently on the tail end of finishing the Back on Track program due to a DUI that occurred this January. I currently have the Smart Start device installed on my car, 6 month period. I had an instance a few weeks back where my vehicle locked out due to not Blowing a retest after the car was parked and I forgot to blow, thus creating a lockout. Smart Start was vague on how to report this - they said to call FL DHSMV, but I am on a pre trial diversion agreement program (BOT) ?? I would like to know who to report to, or how to explain it to Court Options. Also, was wondering if I am able to pay for the 60 community service hours required to complete the program. It's hard to balance work and school find the time to get the hours in. Thank you for your time and assistance.

Can DUI charges still be filed if you weren't in the vehicle and the keys were no where in the area at the time of the accident?
This was a single vehicle crash and the person was out of the vehicle and the keys were no where to be found. A blood test was given at the hospital and showed that the BAC was above legal limit. How could they prove the person was actually behind the wheel. NO statements were made to the police. The vehicle was also not registered under this persons name.
