Expunging criminal record - OVI
I am aware that an OVI conviction is going to be on your drivers record for life. Is the criminal part of this conviction able to be sealed/expunged/pardoned? If the OVI is reduced to Physical Control or Reckless Driving, could either of those be sealed/expunged/pardoned?
In ohio, once you have an OVI conviction you are precluded from have a record sealed. If you get a reduced charge, and...
What should I do? What could it be?
Over two years ago I got my second OVI while still finishing up probation for my first 6 months earlier. I screwed myself. I did the car breathalyzer, the anklet, the house arrest, the community service, the random drug tests, the year of probation, the 10 days in jail. All that's left is renewing my license after the two year suspension. I went down to pay my fines. Warrant block from a failure to appear 2 years ago. No bond. I'm freaking out. When I got these charges I was living in my mom's basement, with no job, and a bum. Now I'm living on my own, had a job for a year, have bills and an actual life. I called my attorney and he said I need to go to AA and get signatures to prove I haven't been drinking and then call him to handle it. Doesn't my life itself show that I'm doing better?
Unfortunately the judge is going to want more proof than just your word. It sounds like you have made some important...
Could I go to jail for not being able to afford my daily breathalyzer for probation?
I was involved in a DUI a year or so back. Recently I was sentenced to one additional year of probation, during which I would have to take a daily home breathalyzer. I am a single dad with 2 children, bills, and rent. I only make a little over minimum wage, and am being asked to pay $360 every month for this test. That is in addition to my rent, the bills, caring for my children, court, lawyers, and several other tests the court require me to take. It has become extremely hard to pay for this simply because I do not have the money.. So my question is, could I go to jail because I can not pay for my daily test? Is there an alternative that they are not informing me about? Thank you.
Any time you have a court ordered stipulation of your probation, you are required to comply. If you fail to comply,...

Hi , One of my friend got an OVI/DUI Ticket with Reckless Driving Note. He was going beyond the speed limit and was pulled over and got arrested. He took He had taken the test but found less BAC only under the limit [.062 % ] , but Police has given OVI with Additional Reckless Driving note and have been asked to attend the court in two days. Can you please let us know how to handle this situation as we have only one day time. Do we need to approach an attorney or can it be handled on own. He is more worried about the H1 Extension that is in process and the Stamping related situations. He has plans to travel out of US in January and so worried about the implications it will have on his career here.
He needs to retain a good OVI attorney as soon as possible. If he does not have an attorney prior to the arriagnment (...
Is missing information on Ohio BMV 2255 form enough to appeal an ALS suspension?
The BMV 2255 form given to me (gold copy) is missing the Time of Refusal or Test and VIN #. Is this sufficient enough to appeal the ALS suspension? I realize there could be many other issues with the form, but these are 2 things obviously not on there.
Certainly you need a lawyer for an OVI. You can appeal the ALS for sure. Whether you'd win that hearing is unknowable....
OVI I was compliant with the officer at first but began bickering shortly after the arrest, how will this effect my case?
In retrospect, I was out of line, if I express remorse at later court proceedings, will prosecutor be lenient?
Police officers are used to people being pretty rude once they figure out they are under arrest. They rarely take it...
My daughter got arrested for an OVI in Ohio, her 1st...what should I do/ expect
She is 22 and still a college student, sorta, she lives at home and was in a 30 day rehab only a few months ago. I left her in jail over the weekend, but it is a long weekend and it is killing me. What should I do before her court appearance on Tuesday?
The Court will most likely inquire as to whether a bond will be posted on Tuesday. In most jurisdictions, there is a...
