Is it possible to avoid jail time on 3rd dui conviction within 6 years?
My girlfriend just got pulled over with 3rd dui. 1st one was 2012 in Columbus Ohio, 2nd in Maryland, 3rd in Cleveland or Parma Ohio only short time ago. She has a drinking problem & recent pullover BAL was .17 Just want to get her help with her alcoholism & avoid jail time

Can a test refusal be tossed if forms aren't filled out correctly
Following a minor accident, police found a bottle of my friend's wife's benzos in my truck. Due to this they charged me with OVI. Alcohol was not suspected and they did not request a breathalyzer. A warrant was obtained to search my blood. The ALS BMV 2255 form for DOES NOT have "refusal" checked. The box to impose an ALS suspension was also NOT CHECKED. The Citation DOES NOT have "refused" checked. He did write on the citation the word "refused" and that a search warrant was obtained. Both documents state I took a blood test and my Citation says there are 5 total offenses. I see today on my online docket that I am now being charged with 6 crimes to include a misdemeanor refusal due to a prior conviction in 20 years. Is it likely I can get the refusal suppressed?

Officer issued me an Administrative license suspension citation, but gave me back my drivers License. Am I under suspension?
I was arrested for OVI a few days ago. The officer did a field sobriety test, arrested me and took me back to police station for a BAC test. I refused the tests, and the officer took me to the hospital for a blood draw. After the blood draw was completed, the officer issued me a administrative license suspension, but gave me back my Drivers license. He told me that once he had results of blood test, he would file charges and issue a warrant for my arrest. He released me, and took my phone number and told me he would call me once he knew what my charges would be, and notify me when I will be required to be in court. My car is impounded, and I tried to get it out, but the towing company refuses to release my car, because the chief of police told him to "hold" the car pending results of blood test. The arrest was in a small town, and I don't think they knew what they were doing. Any clarification on this would be helpful. I'm currently looking for an attorney, but I want to know if i can drive in the mean time. Thanks for any help.

I currently have an OVI case pending. I side swiped a police vehicle (the officer not hurt). I know I passed the field test but they said I failed and I assumed because I hit a police car. The thing is that they sent it to a news station almost three weeks after and went into detail about the case before I have been convicted of the charge.

I had side swiped a cop car one night. They made me take the field sobriety test I passed it and they still arrested me. Took me to the station and tried to make me take the breathalyzer test. I said no. So they charged me with OVI and failure to operate vehicle. Also took my license for the 30 day hard suspension.

Is missing information on Ohio BMV 2255 form enough to appeal an ALS suspension?
The BMV 2255 form given to me (gold copy) is missing the Time of Refusal or Test and VIN #. Is this sufficient enough to appeal the ALS suspension? I realize there could be many other issues with the form, but these are 2 things obviously not on there.
Certainly you need a lawyer for an OVI. You can appeal the ALS for sure. Whether you'd win that hearing is unknowable....
