2nd Dui outside 10 years, What are my options
2nd dui outside of 10 years, first one won dmv hearing but was convicted in court back in 2002. Would this be considered my first dui or second when applying for hardship? Is there any downside if I request a formal review and lose? I know I get a 42 day extension if I request it within 10 days. Have not been in any trouble in 13 years, have bettered my life tremendously, what are the chances of getting this dropped to a wet reckless. I am a single father with no family to help and ex lives in Other state, I am sole provider for my child and need to get to work 22 miles away. Breathalyzer was taken but 4 hours after arrest, is there a possibility of rising bac? Blew .197, I rarely get out but I made horrible choice just looking for anything to save me, no one was hurt, no property damage, very polite to police. DUI Video Evidence was modified, and is missing the first 10+ minutes, a very CONVENIENT block of time to be missing.
Try to keep it simple here: Was pulled over by a friend/coworker and let go with a "Warning, of Observation of Speed". It was 40 degrees with 10+ wind. I was only wearing shorts and a "T-shirt", but I got out of my car to BS with him for a bit. It got cold, blowing warm air into my hands and my legs were shaking, so I said "it's freezing, I'm going to get home, have a safe night, see you at work". At that point his SGT pulls up, says he smells beer, I end up in jail. The police report was made by the initial officer stating he immediately smelled alcohol, and FST requested immediately. Remember he was letting me go!? (Stop laughing) I just saw the body cam video, it begins with me wearing a "jacket", which I requested at time of FST. False Police Report? Body Cam Missing 10+ min?

My boyfriend got his first and only DUI W/ PROPERTY DAMAGE in 12/2011 it is now 3/2014 he paid all the fines, did probation, completed Victim Impact Panels with MADD, completed community service hours, completed driving class and completed his group counselling. He has as not gotten in any trouble since. The property damage was a mail box but most of the damage was to his car.

I've been ordered by the court to complete Level I DUI School, but the DUI School is trying to force me to enroll in Level II?
My DUI charge was reduced to wreckless driving, but I was ordered by the court to complete Level I DUI School. However, I had a DUI about 17 years ago, and now the DUI school is saying I must enroll in Level II? Can this be right? If I've only been ordered by the court to complete Level I??
If the Court ordered Level 1, then that is all you have to complete in order to comply with the terms of your probation....
