Got a DUI and am going through the process of getting documentation from the state. I noticed that in my police narrative, the arresting officer put the name of someone else. i.e. Same first and last name, however, different middle name, DOB, and address. Would this be an important thing to look at when approaching my case? Both at the DMV and in the criminal proceedings?
Any mistake by the officer is potentially significant, but I don't think this will result in a complete dismissal. It'...
I was pulled over because my license was suspended due to failure to not finishing traffic school for speeding ticket. My bic was .066 and it says pending urinalysis. I had .6 gram of pot and paraphanilla as well. Also I had my Xanax in a wrong bottle which I was prescribed my psychitrist . I can prove that they are mine. This is my first offense and I want to know what I need to do.. I have traffic court on this Friday...
You answered your own question. If there is more than alcohol found in your urine analysis, then they may still have a...
In 2005 I was charged with a DUI and refused to submit to a BAC test after running my car into a ditch. I took the guilty charge and suspension and went on to a career in the military. I am now a reservist and was arrested in DEC of 2014 for sleeping in my parked vehicle on the side of the road. I was in possesion of the keys so I was charged with my second DUI. Obviously because I was not driving I refused the BAC test at the time. (What I thought was a good idea at the time). I did not know however that my license would be suspended for 18 months with no chance of getting a hardship. Is there any hope of getting a hardship? I have already challenge the suspension and was denied. I need to get to drill every month and it will become problematic to get to training events in the future.
Unfortunately there's no hardship license issued on a 18 month hard suspension.
Charged w/dui (1st offense) stopped for "speeding" but wasn't visibly intoxicated, refused tests so I was arrested. 2 questions: does judge consider the degree of intoxification on a dui when deciding punishment & also: I don't reside in FL. & only here for work but leaving within 1-2 months when job is done.Am I a more likely candidate to not receive some type probation, attending classes (AA)or possible jail cuz of the fact I won't be in-state much longer? I realize if judge says I'm going to jail or whatever, that I must do so but is a prosecutor more likely to rather see me gone & fines paid than have me most likely lose my job & be stuck here for 6 mo.- year over misdemeanor dui? (I take responsibility but just curious) I have no prior arrests either & work full time.
Best bet is to talk to an attorney in the County you were arrested. Without taking tests and no visible intoxication, a...
First off,I didn't think I was speeding. It was a undercover car that stopped me so I never knew he was behind me. I have out of state tags & feel he assumed I was on vacay & most likely drinking since The stop occurred close to the beach but I live 1/2 mile from location I was stopped at. I'd had 3 beers all night, wasn't swerving in car or swaying/stumbling once outside the car, took test where u follow the pen w/eyes but refused field tests cuz they are ridiculous so then he arrested me. I was not drunk! Is there any way to get it dismissed on grounds he unjustly pulled me over since he can't prove I was speeding? If they don't have to show proof of speeding, what's to stop them pulling anyone over that they want under pretense of "speeding"? Seems really messed up to me.
The smart thing to do is obtain the services of an experienced DUI attorney to represent you. Don't try to represent...
He cannot afford to hire a lawyer. Can a family member show up for him on his court date?
If the family member is a lawyer yes although at some point he may have to appear if he is convicted or takes a plea....
A DUI stop was conducted outside my condo. I used a cell phone to record the incident. Which agitated the police. After they placed the woman under arrest, I suggested she not blow. At which point I was told I am under arrest.
It is obstruction if the state can prove beyond a reasonable doubt that you interfered with the police officers lawful...
