Well, the answer to your question is yes, you can sue him for battery. More importantly, however, you should remove...
hello, i am currently awaiting to plea for a second DUI in one county at the end of the month and i screwed up and was trying to retrieve some equipment and was stopped for DWLSR. the stop was justified as i had turned into the wrong lanes of a 4 lane hwy unknowingly. this is not in the same county the DUI citation was issued. my question is what do i do for the best possible outcome? i have an attorney who bargained the charges of the DUI case and i don't know how the new charge will affect that case. i don't want to be put on probation in one county only to be violated for charges in another once that case is completed. just not sure what to do. thank you.
You got the charge before being placed on probation, so it cannot be a violation of probation. Get your attorney to...
My mother was just sentenced in Citrus County to 9.5 year for her 4th DUI & DUI with serious bodily injury. A plea was entered with a PSI and 10 year cap. What are her options? She had a public defender & I feel important facts were left out. It's been 23 years since her last DUI, I have 5 siblings, 3 in elementary & 2 entering their senior year. PD just sat there during sentencing, no forced blood draw & my mother refused to blow. I don't believe victim's injury meet the statutory def of serious bodily injury & per hospital records he had alcohol & opiates in his system, plus his story as to how the impact occurred keeps changing. He was a flagman on the side of the road & walked into her path, she hit his radio cart which struck him per initial rept but in court he was hit.
Your best course of action is to consult with a criminal post conviction attorney or criminal appellate attorney, It...

I have no money job etc. mostly cause I don't have a license. so give it your best shot at answering, hopefully some one can steer me in the right direction. I still don't have a vehicle nor do I plan on getting one...

I'm a1st time DUI conviction in Florida, I refused the breathalyser test, court ordered inter-lock but I don't own a vehicle.
DMV says for me to get my driver's license back I have to have interlock device, I read that if a person doesn't blow a .15, 1st time offenders then the interlock device isn't required does that include persons that refuse to blow? I got the DUI 5 yrs ago in Dec 2009, I spent a year in jail, because of this ticket I just today paid the financial responsibility fee, enrolling in DUI school etc. all I want is my license back, there are alot of people that have a drivers license but do not own a vehicle. So is there any thing I can do to get around this requirement of the interlock device?
I believe that if you do not own a car, this requirement might be waived, but basically if it was ordered, you have to...
My 2nd Dui since 1997 but not one citation for anything what kind of sentence would I be looking at.
He said I was all over the road but I don't think I was . My front drivers side tire was low on air. And I have several medications I take since a heart transplant in 2004 and issues with my feet and legs that hindered the road side sobriety test and am very concerned about sentencing and getting to my doctors appointments and meds needed daily.
The minimum sanctions for this offense would include 1,000 fine, 12 months of probation, 10 day impound of your vehicle,...
