Can I get this public intoxication ticket dismissed in court?
I admittedly was drunk when I hitched a ride with my friend to another friend's place where I would reside for the night. We were following behind the aforementioned friend where my driver ran a red light. Shortly after we were pulled over (I in the passenger seat) about 3 blocks from our destination. My friend was asked a series of questions and then arrested for running a red light and "being rude to the officer". I was communicating with the officer and she told me that I may walk to my friend's place but that changed when her lieutenant arrived. I was given a field sobriety test and then arrested. I had given the officer the address of my friend's house a couple of times letting her know the proximity of the destination but it was to no avail. Neither of us were read our rights. Help?
These are common and defendable circumstances. Hire a lawyer to represent you. You will be glad you did. Do not...
How do I hire an attorney today for my court date tomorrow for a DUI
I can't believe I totally lost track of time like this and I am absolutely freaking out. I am taking 18 hours majoring in biotechnology and I have no idea where this month went. I have court TOMORROW for a DUI and I can't go to jail. My kids' dad has a restraining order against him and custody orders that say he can't be around our kids unsupervised because he's addicted to meth and was trying to kill me in front of them. This is my only concern. I don't care what I have to do as long as I can stay out of jail so he can't get to them I will be fine. Really I am hoping that somehow a lawyer can ask for an extension or something for me so we can get our ducks in a row. I don't care what it costs at this point because obviously I'm desperate and put myself in this position. If anyone has any recommendations that would be fantastic. Please help me.
Just call an attorney and make s down payment. You may not even have to appear once the attorney is hired.
Are there any pro bono or affordable appeals attorneys for a dwi conviction?
Sentenced to one year probation for dwi by jury. Separated and jobless. Can't afford the high priced attorneys. Are there any probono attorneys who could appeal the dwi case.
Very unlikely. You have money for alcohol you have money to hire an attorney.
Implications of "Obstruction of a Highway" left on record (as opposed to deferred)
Offered "Obstruction of a Highway" at the last minute. Trial tomorrow. The original arrest was almost three and half years ago. The original blood test was thrown out and retested just a couple of months ago, because the original technician or whatever was fired. Another person who labelled my blood was was also fired. The retest came back at .13. My attorney is also saying it was retested way past the expiration date of the blood tubes. She says nothing is a slam dunk because jurys are so unpredictable. She doesn't think the judge will throw out the blood test completely. As far as the obstruction, as I understand it (waiting on call from attorney) I have two options: Just make a straight guilty plea, pay something like $500, and that's it. The other option with the obstruction involves a process that eventually gets it off my record, e.g. probation, classes, more fines, etc. What is the complete downside of just keeping the obstruction on my record. Thanks. Or should I just go to trial.
The downside of a conviction is that it will always be on your record and many people know that obstruction of a...
DWI surcharge installment plan
Following my court hearing for a DWI charge to which I pleaded no contest, I was ordered to pay a surcharge. I agreed to a 3 year monthly installment payment plan beginning July 25 2016. To date, I have made all my installment payments on time. The payment is due each month on the 25th. I recently paid my January installment payment on Jan 5 through the Municipal Services DPS online website. DPS says it takes roughly 3-5 business days for the payment to be processed, and be reflected to my account and driving record. Today, I received a paper letter in the mail from DPS stating that my payment for January has not been received and that my installment plan is in default, so I went to the DPS online surcharge page and it shows that the payment I made on jan 5 has been received, and that my account status is current and not defaulted. Is it common for DPS to make mistakes like this? I do not want to default on my surcharge payment and I have not, yet would it be wise to call DPS and ask them why they sent a letter saying I am in default when their website shows that i have made my payment? Any thoughts or suggestions would be appreciated. Thank you
Contact DPS regarding the default letter. Talking to human is good, but a letter sent by certified mail would be better....
I have a pending dui case in La. and I got a public intoxication charge in Texas..
I have an arraignment for a dui in La. in which I intend to plead guilty. Will the public intoxication in Texas come into play Should I fight the public intoxication cause I didn't take a field test or should I pay the ticket before trial..
You shouldn't be taking any action at all until you advise your attorney on the DUI. Yes it could affect your case if...
Probation VS jail time for DWI and best plea option.
Over a year ago, I was in a really bad accident and went to the hospital where the police took my blood. A month and a half later I found out i had a warrant out for my arrest for a dwi. I've been to court so many times since then but it keeps getting pushed back. No one else was involved in the accident, but my car was horribly damaged. I can't remember most of the details of that night. My blood alcohol level was only .09 and this is my first offense. I think that due to the circumstances I'm just going for punishment rather than innocence. I have a court appointed lawyer who doesn't make much time to get me in. I think I would prefer to do jail time over probation. The prosecuted is offering me 1 year of probation or 6 months in jail right now, but I'm going to trial by jury soon (hopefully). I also don't know if I should plead guilty or no contest. Any advice would be greatly appreciated! Thank you.
