I showed up for my court date this morning, and found that the DA's office sent a memo stating "This office has read and considered the california highway patrol incident report number XXXXXX and is declining to file charges at this time in regards to the above mentioned report for said suspect." I am not sure exactly why and didn't really want to hound the DA office for details. I'd rather not remind them of the case if I don't have to. I noticed that the Memo was written only a couple of days after my arrest so I'm assuming they saw something in the report right away that discouraged them from filing charges? On October 2007 I was arrested on suspicion of DUI while on my way to Yosemite, CA jail to pick my wife up after having herself been arrested for DUI about 4-5 hours previously. After much harassment, I was coerced into submitting to a field sobriety test after which I was told I could pick up my wife only if I submitted to a breathalyzer test if "the numbers were right." I was also told that if I did not submit voluntarily, there was enough evidence to warrant my arrest. I asked questions for clarification, and before I had a chance to reply, I was arrested, and taken to jail after submitting to a mandatory blood test which subsequently showed by blood alcohol level to have been 0.0%. Since then, my DUI charges have been dropped, but the National Park Service continues to prosecute for a traffic violation such as running a stop sign or similar offense. Any arrest on my record can have seriously negative repercussions in my career whether justified or otherwise. Am I entitled to sue for false arrest DUI OVI, civil rights violations, false imprisonment, due process violation, etc? What rights were violated during the DUI stop? Can I initiate a civil case while the criminal case is ongoing? Is it possible to get the arrest off my record? Thank you for your attention and advice.

Told by Orange County court that I was never convicted of DUI three years ago. How does this impact ability to get license back?
I’m a Florida resident, working for a CA company, and spend a good portion of time in both states. In July 2010, I was arrested for DUI in Orange Co, CA, by OC Sheriffs. I blew 0.13 They confiscated my FL D/L and impounded my rental car, etc. After the DA took a couple of months to file on me, I eventually appeared in court and was found eligible for CA’s “first offender” program. For various reasons, I did not sign up for the program. I was subsequently picked up on a warrant for said failure to sign up, plus a felony drug possession charge. I plead guilty on the possession charge, did some county time (to include time for FTA on the DUI case plus dismissal of court costs on same), completed PC1210 program and had my three years of formal probation discharged after one year. Fast forward to 2014. After basically getting by via public transportation and bicycle for the past three years (I was never in CA long enough to complete the three month DUI program) I get laid off, stuck in CA, with now time enough to sign up for and complete the program, hoping to return to FL for work. A treatment provider in LA Co near where I reside suggested that I ask the court to be on an accelerated program which can be completed in six weeks instead of twelve, if the court would approve. But a trip to Orange Co court where my cases were adjudicated yielded a surprise: I was never convicted of the DUI in Orange County! Apparently the case was dropped completely in favor of the harsher drug possession charge (tho I thought I had convictions for both.) Is this just a distinction without a difference? The CA DMV says they will not issue me a driver’s license without completing the first offender program. Florida renewed my license (listed as valid, w/o restrictions on their website ‘til 2021), but will not send me the physical license until I’ve completed the program. Should I just complete the CA program to get my CA license, then return to FL? Does the not being convicted of the DUI have any bearing whatsoever on either DMV? Can I disclose to future employers that I’ve not had any DUI convictions based on the court’s failure to convict even tho I must complete the class for DMV? I have not yet filed the requisite SR22; any possibility I won’t need to without the court conviction? Will legal representation do me any good at this point with either state’s DMV?
