2nd DUI but the charge description says" DUI: Highest Rte of Alc (BAC .16+) 1st Off". Does this mean 1st DUI?
My ex-wife got a DUI back in 2007 and she recently got another one a couple weeks ago. Both are in PA... She did the ARD classes for her first one and there are no criminal records on her file... When I saw that her charge description said "1st Off" it lead me to believe that somehow the courts missed her first DUI and they are considering this one her first... Is that correct? I am really concerned about this because we have 2 children and she is a major alcoholic.

Will I be charged with a DUI after 7 months?
7 months ago I totaled my car. No one was injured, no other parties involved. (Hit telephone pole no damage) Police sent me to the hospital for blood but did not cite me or arrest me that night. It's 7 months later and I haven't heard a word about it. Nothing in the mail. Nothing in my docket. Nothing. And I know my results have been available for my blood work because I know someone who was able to tell me what my bac was. So waiting on blood work isn't the case.

Charged with DUI with Careless Driving. Is my dui an aggravated dui from immigration perspective ?
Recently i was charged with first DUI (bac: 0.16+) and Careless driving. Apart from this there was no other factor involved e.g. no accident, no minor child, no speeding etc. I was arrested, taken to hospital for blood test and then officer dropped me to my apartment. This took place in Pittsburgh, PA. On CBP website its mentioned that one DUI doesn't make anyone inadmissible. But i don't know if mine is simple DUI or aggravated one. I have a DUI lawyer but he doesn't have much idea about the immigration laws. Lawyer said because of first offense i'll be recommended into a diversion program (ARD) which is not a conviction and after fine and probation the records will be expunged. I know that from immigration purposes nothing gets expunged and its always accessible by CBP. Does my DUI will be counted as aggravated DUI in terms of immigration purposes or its also a normal DUI ? I am here on a valid visa and don't have any other law violation. Any advice will be appreciated.

Can I get my dui charges dropped considering these circumstances?
I got oulled over for speeding and the officer flagged down the car behind me which was my friend following me home. They took my info and gave it back, talked to me multiple times and told me to just wait. Gave her a sobriety check then breathalyzer and tells me she's going to hospital for blood work. Two different officers ask me if I can follow them to the hospital to pick her up. I agree. Then they ask me for directions to the nearest 2 hospitals to which I answer. Then a state trooper pulls up and all of a sudden starts yelling at the other two officers. One comes back and just says you smell like alcohol step out of the vehicle. I do the tests and fail my breathalyzer. Agree to get bloodwork done. End up getting charged w duo. Based on them giving me consent to drive previousky?? (mind you at least 30 mins passed in these conversations before other officer shows up and yells at them) and my police report is filled with charges that are completely wrong like not wearing my seatbelt and following too closely to another vehicle when i was the one being followed. The police report says nothing about me talking to them for 30 mins before being asked to do a sobriety test.
