What kind of jail sentence can I expect for a first time DUI in Escambia County Florida?
I was put on probation after receiving a below .15 DUI conviction in Escambia County. I was placed on 12 months with early termination after 6 months if I could complete all of my terms. I have completed most of the terms and made it to almost 5 months. But I recently caught a new charge in AL and have informed my probation officer. I wasn't arrested immediately, but she informed me that I would be violated and a warrant would be issued for the VOP. She has informed me of the court date and has advised me to turn myself in close to the date so that I may not have to stay in jail for too long. This hints to me that she will recommend for me to remain on probation probably with stricter terms and no possible early termination. My question is how much time should I expect to be sentenced to if I choose not to go back out on probation and just serve the time out? I know the sentence maxes out at 6 months, but I also many most people are not sentenced to the full 6 months. I really need help because this could really sway my timing for turning myself in, and whether I will try to complete the rest of my terms in the next week as my probation officer advised me to do. I
The best advice I can give you is to retain an attorney in the Panhandle who has a working relationship with the judges,...
Curious to if my situation makes me liable for any penalty in the case of a failed alcohol/drug screen.
I recieved a DUI 5 years ago in Texas, and I have Florida license. I went through the entire process in Texas (plead guilty), paid the fines, did a day in jail, and moved back to Florida. A year later I renewed my license. I completed the initial treatment and moved cities to finish school. Fast forward two years and I get a notice stating that my license is cancelled because I didnt complete "counseling". I knew about the counseling but forgot over the years. Now I have no transportation and 8 couseling classes to go to before I can get my license back (I can only make it once a week due to my school schedule). Question: what would happen if I drive on a cancelled license? and since this is only license related would I be in any further trouble if I was positive on any alcohol/drug test?
If you get caught driving on a cancelled license in Fl then you will face criminal prosecution and 364 days in jail....

Will I go to jail?
I was convicted of a DUI in Florida five years ago. I was granted permission to go to Michigan for the summer to take care of my mom, as long as I called the PO the first week of September. I did. The PO didn't remember any of this and had turn me in and a warrant was issued, although I received no notice. I called my attorney and he said I will go to jail and the judge will see me on her schedule which may be a month. I take care of my 88 year old mom . I have residence in Alabama although I spend a significant amount of time as a caregiver. What should I do?
At some point you need to take care of the violation of probation warrant that is active. There are too many variables...
Can I file a motion to get my driver's license back?
I got a DUI last May, the DMV suspended my license for a year immediately, I finally pleaded out this December and received an additional 12 months suspension. I'm familiar with motions and all that, I just want to see if I would have a chance to terminate the suspension as I've been without a license for a year, and I feel that the intention of the suspension has fulfilled.
I do not think a motion will suffice
What do l do for violation of DUI probation, was driving while on suspension, given 2 tickets.
No background.
Hire an experienced criminal defense lawyer. Also try to get your hardship if eligible. Good luck.
I was arrested for a DUI but did not blow. Can it be dropped down to reckless driving.
This is my first arrest. I'm 34 married and was out with some friends. Originally the officer said he pulled me over because I was speeding but then smelled alcohol on me. I did the field soberity test and that's when they arrested me. At the police station I refused to take the breathalyzer test so they took my license. Since then I have signed up for DUI school and received me hardship license. I'm worried about having a DUI though and would like to only get wreckless driving if possible. On a scale of 1 - 10 what are my chances.
it is not that easy. no one can answer your question without a great deal more information. over the years thousands...
