Why was his arrest description labeled as Controlled Substance Violation?
My son went to court recently for a Status Conference relating to a DUI/Controlled Substance charge from previous year. The pills found on my son last year ended up being generic phenergren (nausea med), which is not a Controlled Substance but Controlled substance charge was never dropped. So, during Status Conference, Judge ordered drug testing in court, results showed thc & benzos. Judge put him in jail for 10 days and the arrest record online is labeled as Controlled Substance Violation. Seems like the charge would be more like Failure to Comply. Am I wrong?

Can state police conduct a sobriety checkpoint on federal property that subsequently leads to a DUI under state law?
A local Sheriff's office conducted a checkpoint on the Natchez Trace Parkway, a federal parkway which spans Mississippi and parts of Alabama and Tennessee. There were no U.S. Park Service personnel present at the checkpoint, and a driver was subsequently arrested and charged with DUI under the state's DUI law. Does the county Sheriff have jurisdiction sufficient to enforce a sobriety checkpoint on a federal road? Why wouldn't the U.S. Park Service not hold the checkpoint? I am under the impression that a DUI on a federal parkway is a federal DUI, and not a state law DUI. If so, how does the County Justice Court have jurisdiction over traffic laws on a federal road that merely incidentally passes through the county?

First, could a question be raised regarding lack of jurisdiction to conduct a checkpoint by county Sheriff's deputies on a federally-owned road? Second, does the county justice court have jurisdiction over the arraignment of the DUI that was issued by those state police on a federal parkway? Third, if these questions can be raised, on what basis can the U.S. Park Service delegate authority to police federal property to state police? Fourth, and finally, if police powers cannot be delegated to the state police on a federally-owned road, would the appropriate legal recourse be to challenge the validity of the checkpoint based on lack of jurisdiction?

Should I try and get a lawyer or take the easy way out for 1st offense non ajudication dui?
I was leaving a bar. I got pulled over for running a stop sign. I gave my license and insurance the officer asked me to step out to do test because he felt I was driving while impaired. We went back and fourth for about 15 mins because I felt it was a cheap shot pulling me over for a stop sign no one stops at or the cars in front of me didn't. I never refused to take the test but I guess I talked myself into getting arrested for the dui. Basically he said you know what your under arrest. I honestly didn't not resist arrest but as there were two cops there when my hands were being placed behind my back, one cop raised his voice yelling quit resisting arrest, he then grabbed my hair and tried shoving my head down and the other cop who was placing cuffs on me hit me twice in my ribs. At the station I drank water a few times waiting for the cop to get done writing his tickets on me or report while the booking guy asked me information then I took the test. I blew a .09. I was never observed for 15-20 mins. I drank water 2-3 times at the water fountain. This was all about an hour after I got stopped. Is this worth trying to fight and get a lawyer?

Kansas Dui help out of state
I was in a motorcycle wreck in 2012 while visiting my mom in Kansas and was taken to the hospital. I was never arrested. I have lived in Mississippi for 20 years now. I did live in Kansas as a child. I just went to have my MS license renewed and was told that Kansas had a block on it and gave me a number to call. The lady at the Kansas DVM said I had been convicted of DUI due to a blood alcohol test done in the hospital. She told me I needed to write a letter stating that I was no longer a resident of Kansas and list my name, ss# address etc along with a money order or check for $25. She said I would then receive a letter of instructions to follow. Is there anything I can do?

Do I need a Dui Attorney?
I was parked with an open alcohol container by a lake. I have the music on when we walked from the pier. So when the police came to the car and shined the flashlight I had to to a field sobriety test, which I passed. So I blew in the breathalyzer and blew a .08. My fiancée blew a point .04.. He was going to be driving home anyway, which I'm sure will be irrelevant. We live less than a mile from where we were parked, btw. They did not take me to jail, however they gave me and open alcohol ticket and I have to appear on the 17th of July for a Dui? I could really use some advice. I met with a attorney the next day and we don't have much faith in the man. For the money that it will cost I want the best possible outcome, thanks for your time.
