Is a job allowed to hire you before drug tests come back?
Recently got a job as a mechanic for a dealership, and was fired after a week because my drug test came back positive. I thought I passed because they full on hired me. I put in my 2 weeks at another job for this place and got completely screwed over. Shouldn't they be healed responsible? Yes, I was the one who failed the drug test, but they hired me (all legal paperwork filed and everything) before it came back (almost three weeks after I took it). Something doesn't seem right about that.
This is not a criminal matter. This question should be directed to a labor and employment lawyer on AVVO.
How can paternity tests differ?
I took a court ordered paternity test through a lab in 1999 that came back negative. The boy (Now 25) asked me if I would be willing to take another test as his mother has been telling him his whole life that I was the only possible person that could be his father. I obliged because I wanted to give him closure. Well, the test this time (Again done at a lab) came back positive. How can this even be possible and which test do I believe? I am extremely confused. Also could I be under any legal or financial obligations? The original paternity suit was dismissed with prejudice in 2000.
Changes in how the tests are done in 17 years could explain the test, contamination, mix up in samples, there's a...
Do you have to reinstate your license twice?
Recently I have been asking questions about the reinstatement process and I am still confused on one part of it. on my BMV record I have two BMV case codes. One stating a ALS suspension and another saying a court case suspension (which was the same length, 6 months and ended the same time). My suspension ended on NOV, 25 and my driving privileges ended at the end of the month so I had no choice to reinstate if I wanted to continue to work. My court case was finished on Dec, 19th so I already had a valid license from the BMV. once the case was closed was I required to reinstate for a second time because of the timing? Both suspensions are under the same code, 4511.19 and have the exact same reinstatement process (wait for end of suspension, pay fee, show insurance). I ask because I was cited for a "Failure to reinstate"when I was pulled over for a traffic violation. I clearly reinstated the first time... was it a issue because I did it before my case was closed? I was under the impression that once I did it the first time everything was taken care of, the court added not additional charges or suspension.
The bureau has picked up the sentencing suspension as a different court suspension, which the court may have intended...
What is a "ALS COURT DISPOSITION NOTIFICATION"
On Dec 5th, 2016 I reinstated my license, I paid all fines and provided proof of current insurance. My suspension was over on Nov 25th, 2016 and it was only a 6 month suspension with no violations. Is it a issue if you reinstate your license before you are done with your court case? My court case finished December 19th. I noticed that in my case history they submitted a ALS court Disposition notice. what exactly is that, and am I required to do anything for it? The end result of my court case was a charge of a first OVI, 6 month license suspension, and a fine. I ask because earlier this May I was pulled over for a traffic violation and the officer told me my license had not been reinstated. But I have the documents to prove I did reinstate... you dont have to reinstate twice if I did it before my case was closed, do I? I am extremely baffled because I feel it was a error on the BMV considering I fallowed the reinstatement process properly. I got everything fixed at the BMV, they never faxed my insurance somewhere. They were as confused as I was, same with the cop who pulled me over. Now I have to fight a "failure to reinstate charge". I am in Mayors court.
In most cases a court suspension would replace the ALS or administrative license suspension. The court will usually...
How does license reinstatement work? (in Ohio)
Hi, about a year ago I received a DUI and had a license suspension for it. my suspension ran 6 months without much issue and the day came when I finally could reinstate my license. for months I had the BMV mailing me about my failure to reinstate so I was happy to finally get it done. I went the local BMV and paid my fines, showed them my insurance, and bought a new license. 5 days later I received a letter from the BMV stating my license was valid. I did this two weeks before my case was closed (I just needed to enter my plea) which im assuming was no issue. I plead guilty to the charge of the DUI and the Judge gave me what i expected: 6 month license suspension (at that point it was over and done with), a fine, and some probation. a few days later I received a letter from the BMV saying my license was no longer valid, which was confusing. This time around there was a different BMV case number on it which I thought was odd... i went to the bmv to ask why and they had no idea what was happening. I have all my fines paid off, my suspension is over, and i already reinstated... what could the reasons be? the Judge did not add any additional charges or anything
Your driver's license is valid. The letter you received following your in-court plea & conviction to the DUI/OVI...
I was pulled over for a "Failure to reinstate license". Can I fight this?
I was arrested for a DUI in May 2016 and was placed on suspension for 6 months. The suspension ran its course and I was able to apply for reinstatement Nov 25th. During this time I had to get new insurance which was in effect on Nov 19th. On December 5th, 2016 went to the BMV and went through the reinstatement process. I paid my fines, gave them my new insurance, and purchased a new license. I left the BMV with a new valid license. A few days ago I was pulled over for expired plates and the officer told me my license was not reinstated, which baffled me. I informed him that cant be right because I took care of everything in December. I went back home and looked over my documents. On the day I reinstatement my license I left the BMV with two documents. Both documents clearly state, "Ohio License status: Valid". They also read, "Your reinstatement requirements have been satisfied". Clearly there was a mistake. apparently the BMV failed to file my insurance the first time. Do i have a chance to fight the charge? I did everything I was asked, it was a mistake on the BMV. i go to mayors court in a week. Im concerned because I am on non reporting probation.
You should certainly fight the charges. You will require a good attorney. Sometimes when insurance screw ups happen...
I was charged with ovi and I have 2 prior ovi' six 6 years. However one was amended to a physical control.
When they do the look back will the amended charge still count as an ovi or will it not count since I plead to physical control?
The look back period is now 10 years, not 6. That just changed last month and the change may or may not apply in your...
