Do I need a lawyer to get my license back after 2nd offense (that was NOT in the US?) What are the penalties?
I have a DWI pending in Canada. I know that MI and Ontario share info, and I will be receiving the driver responsibility fee penalty. how will this affect anything else? (it is my second offense) I assume I will lose my license for a year... but then what? I want to be proactive so that I will be able to get my license back as soon as possible. Will I need a lawyer for this?
If you get 2 OWI's within 7 years, your license will be automatically revoked for 1 year. After the year, you have to...
I have 1 DUI on my record and want to go into the dental assisting program. Will I be unable to get license?
The DUI is the only conviction I have on my record.
What do the dental assisting licensing requirements say? If you include the relevant language here, it'll be easier to...
My boyfriend got into a car accident because he was driving drunk. He didn't take the breathilizer. He is 21, and has 3 MIPs on his record from his teenage years. He attends AA classes now and has been sober since the accident.
I'm sorry but your question is impossible to answer. The answer to your question depends on a multitude of facts that...
My friend and I got into a fight in her house in which I attacked her and she attacked me back. We were both drunk.
I called the police because her and her roommate locked me out of their house (her roommate was a witness but also drunk) and they had my car keys. I was out of town and had no way of getting home. The police asked her if she wanted to press charges and she said no so they brought me to their lobby and I waited for a ride. My husband went to pick up my car and the keys were laying next to it and my car was keyed all the way down the body. Am I going to get charged at a later date by the prosecuting attorney? We both suffered injuries and my car was damaged while I was at the police station. If charges are filed will a warrant be issued for my arrest or will I just get papers to appear in court? What are the odds that I can get my case dismissed?
Self-defense can be a perfect affirmative defense to the charge of assault. Voluntary intoxication can be a mitigating...
OWI third offense(felony) charge in Kent County, is there any possibility of getting this charge reduced to a misdemeanor?
I was charged with OWI third, had two prior convictions, one as a minor. I'm hoping not to lose my ability to possess a firearm, any chance of getting the charges reduced in this county?
What you are trying to do is usually very difficult, but not impossible. There are MANY very good OWI Grand Rapids-...
Just out of curiosity, since I have never been in the system before with a clean record, I am just curious what happens on the day of my pre sentencing? What happens on that day? Also what does it mean by Alcohol Assessment? Will I have to drop on that day? Will I have to drop in general? Judge never said anything about probation when I plead guilty to an impaired driving.
The Alcohol Assessment is essentially a guide for the judge to understand what your alcohol history is, meaning...
I have exhausted all options short of applying for a pardon to alter a conviction of OWI third. I see that a collateral attack on a prior conviction in which I was not informed of the importance of retaining counsel at the age of 17 after receiving my first OWI may be an option. Is this possible and is anyone interested, looking to retain competent counsel. I need help, unfortunately I made mistakes when I was 17, 19, and 24, have maintained sobriety, graduated from college with multiple degrees and still am lagged by this conviction in every way. If attending law school was an option, I would do this as my background as a Historian and grades are good enough too, but the reality, just like with so many other positions is that I am barred sometimes by law and de facto policies.
The most often used line in law is "ignorance of the law is not a defense". Unfortunately, that is a true statement of...
