Do I need a lawyer to get my license back after 2nd offense (that was NOT in the US?) What are the penalties?
I have a DWI pending in Canada. I know that MI and Ontario share info, and I will be receiving the driver responsibility fee penalty. how will this affect anything else? (it is my second offense) I assume I will lose my license for a year... but then what? I want to be proactive so that I will be able to get my license back as soon as possible. Will I need a lawyer for this?
If you get 2 OWI's within 7 years, your license will be automatically revoked for 1 year. After the year, you have to...
I have 1 DUI on my record and want to go into the dental assisting program. Will I be unable to get license?
The DUI is the only conviction I have on my record.
What do the dental assisting licensing requirements say? If you include the relevant language here, it'll be easier to...
My friend and I got into a fight in her house in which I attacked her and she attacked me back. We were both drunk.
I called the police because her and her roommate locked me out of their house (her roommate was a witness but also drunk) and they had my car keys. I was out of town and had no way of getting home. The police asked her if she wanted to press charges and she said no so they brought me to their lobby and I waited for a ride. My husband went to pick up my car and the keys were laying next to it and my car was keyed all the way down the body. Am I going to get charged at a later date by the prosecuting attorney? We both suffered injuries and my car was damaged while I was at the police station. If charges are filed will a warrant be issued for my arrest or will I just get papers to appear in court? What are the odds that I can get my case dismissed?
Self-defense can be a perfect affirmative defense to the charge of assault. Voluntary intoxication can be a mitigating...
My boyfriend got into a car accident because he was driving drunk. He didn't take the breathilizer. He is 21, and has 3 MIPs on his record from his teenage years. He attends AA classes now and has been sober since the accident.
I'm sorry but your question is impossible to answer. The answer to your question depends on a multitude of facts that...
I was arrested on a owi for listening to the radio in my truck while smoking on my own private property. Should I fight this?
I was out drinking with some friends. My buddy dropped me off at home and I decided to sit in our truck and have a few cigarettes before going inside my home. (We don't smoke in the house) My neighbor called the police because he thought something suspicious was going on. I did not drive anywhere at all. The prosecuter still wants to charge me just because I had the keys in the ignition. I was on private property and had no intention of driving anywhere. Basically I'm being charged with an owi for operating a radio while intoxicated. I'm afraid that if I go to trial and lose I'll get more jail time.
In Michigan, having control of the vehicle is good enough to be charged with drunk driving/ In the drivers seat with...
Being charged with a DUI for an accident that wasn't my fault that resulted in severe brain injury. Is there anything I can do?
My brother-in-law is the one being charged. He has two previous DUI. He was driving through a green light and another driver ran the red, striking the passengers side. His brain injury caused by the accident is extensive and long term. There was a warrant out for his arrest in regard to that accident and he turned himself in. He has taken no legal action against the driver who ran the light. His court date is November 5th. What should our course of action be and what can we expect on the 5th? It seems like his injury should be justice enough.
First, I am sorry to hear that he was injured and hope he does eventually heal. That being said, this is a VERY...
My sister recently got a DUI in Michigan and blew a .18 at the scene and a .14 downtown. She is a paramedic and will lose her job if it is not lowered to a reckless driving. Any recommendations on the best way to fight it? She mentioned that he did read her rights. Not sure if that's a factor. Any help is appreciated! Thanks!
There is always a chance, but it will not happen without the help of a very experienced OWI lawyer. There are a lot of...
