Can medical problems influence a breath test ?
The Breathalyzer and Acid Reflux People suffering from gastroesophageal reflux disease (GERD) have an increased risk of getting a false-positive result above the legal limit on a breath-alcohol test. Even if only a very small amount of alcohol is consumed, many GERD patients have tested above the legal limit of 0.08, placing them in danger of a DWI conviction. Because of all the above factors it is essential that you contact a DWI defense lawyer if you are ever arrested for drunk driving. I had smoked a ciggerets right before because he told me to put it out And used hairspray earlier Also I have pkd And have had a history of high keytones Also I have acid reflux Take medication pertini And take meds for anxiety
You've answered your own question. You should contact a criminal defense attorney to discuss the specifics of your case.
OWI in Iowa first offense ?
I was arrested for my 1st offense OWI in Iowa over the weekend. I was initially pulled over for my license plate light was out. I tested .155 on the breath test, but also demanded an independant blood test at my own expense. My blood sample was just thrown in with all my other personal belongings when I was put in the jail cell. It was not refridgerated. I guess I don't know what the proper procedure is for my blood sample, but I don't think it was handled right. Do I have any chance of getting this reduced or thrown out ? If I am convicted of the OWI, I will lose my job, home and be probably bankrupt ?
Unfortunately, not refrigerating the blood sample for hours or even days following the blood draw generally does not...

What does "no action on motion until procedendo issues" mean?
So my children's dad and I are sorting out custody right now. He sent in a parenting plan to which i responded (through my lawyer) that I didn't accept it because of domestic violence and in it it just said refer to docket #'s xXxX (and had different ones for different charges) I also filed a petition through my lawyer for him to take a drug test because he's been known to use drugs. And I really don't want him to have unsupervised visits of he is still using. To these he responded with a motion to strike against the references of the domestic violence as "irrelevant evidence" which it wasn't even submitted as evidence it was just referring to it staying the reason he should have supervised visits is because he has a history of violence and drug use. He also responded to the drug test and write a statement saying he wasn't going to take it because he would fail it for drugs and that he has to take one any way for terms of his probation. Which isn't true because I talked to the county attorney after he was convicted and she said because it wasn't a drug related charge he doesn't have to drug test. The judge responded with "no action until procedendo issued" what does that mean
This is a great question for your lawyer. We cannot give advice to a represented party.
Is there a way to get my license back without getting the interlock installed?
I received my dui 10/14 And I have been eligible to get it back since 10/15, I was charged with a 2nd 1st dui. I have no vehicle and I need to get my license back in order to work. But without a vehicle to install it in I feel stuck. I need to work to get a car but need a car to work. I have a 9 month old son that I stay home with but I am now needing to go to work, is there anything I can do? I live in a small town in so public transportation isn't an option .
If you have an interlock requirement, you have to follow it. The criminal laws are not designed to bend to people's...
Will I be extradited for an dui I got halfway across the country?
I have fulfilled most of my supervision requirements than missed my revocation hearing in Des Moines, Iowa, My question is will they send a bus over 1000 miles for a serious misdemeanor and contempt? Or will they just hold me for the 30 or 60 days and release me?
No clue what they will do? None of us have your case nor know what the prosecutor will do.
Can an employer legally drug test based on the following?
My employer pulled me for a drug test based on "reasonable suspicion", due to the fact that I allegedly made comments about [casinos] not being able to do anything about employees smoking marijuana. It was alleged that I said I would partake. he comment was made in reference to the state of Colorado and their drug testing policies. I also returned today from a trip to Las Vegas. I was forced to take a U.A. (negative) and was also told to perform a breathalyzer, whose results were also negative. When I asked for a copy of the breathalyzer results, the security manager declined, stating that the results were the property of my employer. I work for an Indian tribe. Are the results in fact, the property of the casino? Additionally, this event does not seem to be covered by our drug testing policy.
Drug testing very much depends on the jurisdiction and the nature of the job. If you drive or operate equipment, then...
