Is my dad above the law?
I wanna charge him with attempted murder. I couldve been gotten in trouble cause I'm scared to speak up. I already gotten in trouble for doing so. but that's another story. my dad has a comany car that it's back right side wheel didn't wanna rotate. He had it fixed but when we went for emissions test he yells at me for going to fast. He says brakes might not work. He kept that info out til we get on road. He has no regards for safety. Can I get my license reinstated in Illinois after 2 DUI's and 1 year of driving on an RDP?
Early 2009 I acquired 2 DUIs, went through all the court orders but didn't apply for a permit until last year. In April I got approved for an RDP for school and went in to speak with the informal hearing officer for an additional permit. He informed me that I would be eligible for a full reinstatement at my next formal hearing since it's been over the 5 year requirement. He explained that I would have to have the BAIID for 5 years. In the order from the formal hearing, it says "petitioner has two or three convictions for DUI and is only eligible for a restrictive driving permit to be driven on for five years without any significant BAIID violations prior to being eligible for full reinstatement. 92 IAC, 1001.410" Am I being told wrong or just misreading something here? When I go in for my next formal hearing will I be eligible for reinstatement or only RDP for an additional 4 year?

Can the charges be dropped due to an unwarranted search
A family member was stopped for suspended license after their license plates were run by a patrol car. They were arrested and vehicle was searched. A baggy with cocaine residue was found in the vehicle, according to police. They were charged with possession of a controlled substance. After some digging, it was found the license was not actually suspended at the time of the traffic stop, but the states system was not yet updated with this info. Since the license wasn't suspended at the time of the traffic stop, could the possession charges become invalidated as a search wasn't warranted?
As long as the police acted on a good faith basis that the license was suspended, the traffic stop and arrest is good....

My lawyer isn't much help. He tells me that I look good on the tape, I'm not stumbling and I'm following all the commands. He said that the only thing that he sees wrong is that I was talking too long and it took me 7mins to refuse the breath test. I told the officer that I was willing to do anything but the breath test. The only reason why it took me so long is cause I was asking him is there anything else I can do to prove that I am able to drive home. I kno someone is going to say than why didn't you blow. That's cause I don't trust the breathalyzer. It's not 100% accurate. I didn't want to get arrest and I kno I wasn't drunk. Why because two freaking drinks and no one can't possibly get you a dui. I took the breathalyzer at the station because he told me that my license was going to be suspended and I didn't want my license so I blew .08. With that being said will I get convict for it eventho I'm not over the limit.

How long can the state typically delay 1st discovery in a criminal misdemeanor dui before a sanction would likely be granted?
Our lawyer has been trying to obtain the police video in my son's misdemeanor dui case for about 17 months and 15 continuances (all continuances have been related to the state not producing the video). Please focus your answer on the criminal case only. My son has already served his 12 month drivers license suspension and he never got his summary suspension hearing. The attorney waived my son's right under Trainor which was his screw up (my opinion) and is in the past now. I never pushed the issue about the summary suspension hearing with my son's attorney because I believed my son needed to be taught a lesson. My concern is that similar mistakes are potentially pending on the criminal side. Either you have eminent knowledge regarding the applicable strategy and the trade off between a speedy trial and discovery sanctions or you don't. The number of appellate cases out there where incompetent attorneys failed to raise issue at the lower court level is alarming. I'm not look for basics like 120/160 as the state statute for a speedy trial. Wow me with your knowledge of the subject as I'm looking for new representation.
