Can i get house confinement for my third dui in?
I have two dui in Pennsylvania and just recently got my third in oregon. It's been almost 12 year's since.
Whether you're eligible for house arrest (possibly electronic monitoring, likely with a GPS ankle bracelet to track you'...
How long do i legally have to have a IID in Oregon?
I got a DUI well over a year ago. Went though diversion. Im not on parole. I recieved a letter from DMV explaining i had to have a IID in my vehicle for 90 days. It didnt specify anything else. Now im being told by DMV, now that my 90 days is almost up, it has to be 90 days with no violations. There might be 2 fails within the last month from drinking the night before and not getting enough sleep. What now?? I drive this vehicle for work and im due for a newer vehicle at the end of this 90 days (2 weeks.)
DMV is the keeper of driving privileges. It sounds like you already know why they want another 90 days. You will have...
Second dui in the same month bac were .08 & .1 it was stupid I’m aware, field test were passed flawlessly didn’t feel impaired
Mandatory jail time for this ? There was no damage, collisions, injury. Got pulled over for unsignaled turn and driving straight in a turn only lane (thought it was okay didn’t see the arrow)
DUII means you were impaired AT THE TIME OF DRIVING (rather than at the time of the breath test) or your BAC was ,08 or...
When a conditional discharge is revoked will the law thats in effect now apply to your charge or when the arrest happened?
i was given a conditional discharge for possession and violated probation by driving with a suspended license. my parole office gave me community service hours which the DA objected to & put a warrant out for my arrest. i have a court date which I'm assuming they will want to take away the conditional discharge and I'm wondering if it will be a misdemeanor with the new law even though when it happened it was a felony?
The lawyer who got you the conditional discharge will be able to answer these questions. On the felony question: you...
Is there any remedy for a Petition to Reset a Trial that was denied?
I have a misdemeanor criminal DUI Trial (which I am the Defendant) set for 12/5/17. I have retained an expert for the trial who in unavailable the date of the trial. I am currently represented and a Petition to Reset the trial was filed 10/25/17 and denied 10/30/17. The DA had no position either way on the Petition. Is there any remedy for the denial? I feel I cannot adequately represent myself without my expert present. thanks.
This is a question for your attorney to handle, and you should be asking them instead of the internet.
Can I have my probation for DUII be overturned so that I can pursue work in England?
I have currently been "denied" by the Background Check Unit in Oregon to work with vulnerable individuals as a result of a non work related DUII. There was no harm to a person or property. My fiancé is a UK citizen, and it makes sense for me to move there where I can pursue work. I am 6 months into my probation. Do I have legal recourse to have the probation overturned for work and personal relationship reasons? I have tried to appeal the BCU's denial, but no longer want to pursue attempting to get this rectified.
It’s not likely that you’ll be able to get your probation terminated so quickly. At a minimum you will need to have had...
Can I enter diversion for DUI and plead innocent to reckless driving?
Arrested for a DUI while parked in a closed park listening to my radio and drinking beer. Tested .09, no jail just citation. Cop didn't show for DMV hearing I won. Went to 1st appearance and the court had no charges. Today 2 months later, received a letter for a court date and I was ready to accept Diversion vs the risk/reward of fighting it but the DA has added reckless driving to the charge. I want to request diversion for the DUI despite being in a place closed to the public but I want to fight the reckless driving since I never drove. I will lose license and SR22 for the reckless driving charge.
Yes, you can plead to the DUI and enter diversion and fight the Reckless Driving charge. That said, it is fairly common...
