What happens when you have a FL driver's license and get arrested for DUI in NC, whose laws are followed?
If you hold a FL drivers license and are arrested in NC and they take your license and give you a court date, then will your penalties be governed by the laws in NC, or will you be subject to the penalties of the state in which you are licensed, in this case FL? What is most likely to happen with my driver's license after my drunk dad blew into my interlock device?
In 2009, I was convicted of a DWI, and I was 18 at the time. I've since completed the community service and paid the fines and I now have a Monitech interlock device installed on my car, and have had it on for about 5 months with no fail readings. Last night while I was sleeping, my father was drinking and decided to blow into my device (he's never driven the car since we had the device put in, but has seen me operate it). He apparently wanted to see if it worked. I've been reading that I'll most likely receive something in the mail from the DMV saying they want to revoke my licence and I might have to attend a hearing. Is there any chance that I will be able to keep my license? I haven't drank any alcohol since the arrest happened in '09, and I'm really freaking out.

Charged with DWI while being a passenger based on statement that I was driving earlier and stopped to switch to sober driver
Driver was pulled over due to excessive horn use (honked at friends at gas station, cop was there), cop observed driver touch the center line with front tire, driver blew .07, I blew .14, but was passenger. Officer admitted he did not observe me driving. Driver was charged with aiding and abetting DWI, I was charged with DWI. I don't understand how the statement that was made (I was driving, I pulled over to put the more sober driver behind the wheel) could get me charged with DWI and license suspended for 30 days. Already in the process of getting an attorney, but I might go to the DA with my buddy to explain what happened and try to get the charges thrown out (no observation of me driving at all).
