What happens when you refuse to blow, but they do a blood draw?
From AR got pulled over 6 mo ago in Bolivar MO, did not blow, but did blood draw. Received letter saying mo driving privileges were lost. But I don't have mo license. So wondering if I just lost driving rights in MO, or in AR as well. Will it show up if pulled over in AR?
Call a Dwi lawyer right away. Depending on when the letter was sent to you there might be an opportunity to file for an...
Why after my dui case was completley dismissed do i have to do satop?
a friend an i went over to a freinds house, in my car my friend was driving. i had been drinking. Long story short, my friend left me and my car there. The police were called after guy kept saying he was gonna kick my @$$. They claimed I showed up drunk and alone. The police arrived I approached them and was immediately greeted with a breathalyzer. obviously failed it and was arrested. Later in court my DUI was completely dropped. But because I was charged with a DUI and had positive breathalyzer the DMV has it on file I was driving while intoxicated. I have to pay for a reinstatement fee, satop, interlock device, and sr22 ins. And that on my driving record.
A DWI usually results in two completely separate legal proceedings. One is criminal (you see a judge) and one is...
Can I get a hardship license if I refused to the breathalyzer and have been suspended for 10 years
I have had 8 DWI's and went to DOC for 3 yrs. refused breathalyzer's and wondering if I can still get a hardship license.
State specific but my guess is no, you probably would not be eligible for any form of license, hardship or otherwise....
Why havent i heard about a court date or been notified that my case was dismissed?
I was arrested on 9-15-2012 for a DWI-drugs, I failed the sobriety test because of my usual unsteady balance, and a recently fractured foot. my blood pressure was also high I found out later that day..which explains my dizziness. I was taken for a BAC then booked into jail, and released. I have tried on many occasions to speak with the court clerk with no luck. they have not gotten my BAC back, (I was not drinking at all and had only been taking medications prescribed to me, and none would have affected my driving) so what should I do to find out something? I have already lost my licence nearly 3 monthes and under MO law (even if my case is dismissed The DMV will still require me to lose licence 30-90 days, get SR22 insurance, and attend SATOP classes which I think is so unfair!!) HELP!
I have represented a number of people accused of driving while under the influence of drugs, and it is not uncommon for...
Missouri DWI.
I am an Illinois resident and have an Illinois drivers license. I was charged with DWI in Missouri in August. It was my first time ever being charged with any type of crime or alcohol problem at all. I am 58 years old. I received in the mail today a notice telling me that I lost my administrative hearing that I had on December 18 with findings of fact and conclusions of law. It lists things that I need to do in order to get my privilege to drive in Missouri back reinstated. But, what I want to know is what do I need to do to protect my driving privilege in Illinois? As I understand it, MO will send this violation to Illinois and they will punish me under the laws of Illinois as if the DWI occurred in Illinois, is that true? Additionally, I plan to hire a lawyer to file for a trial de novo in Missouri. Does the trial de novo have any affect on the suspension? So, I need to know how my driving rights in Illinois will be affected, when they will be affected, and what I need to do and what I can do as far as getting a restricted driving privilege to be able to travel for work, etc in Illinois. Can someone please answer this for me thoroughly? Thank you so much!
A MO licensed attorney can try to get you a new hearing/appeal, but the license will remain suspended. IL will be...
Did I get a good deal on my dwi case?
First time offender in Missouri. I did refuse to blow so I was looking at a 1 year suspension. My attorney is supposed to be the best around for this and at $10,000 I expected a great outcome. The 1 year suspension was dismissed. I received an SIS, 2 years unsupervised probation and 40 hours community service. I feel this is the same deal everyone gets.
Sometimes you are just going to get what everyone else gets. it's not always up to the attorney, no matter how much...
