How long does it normally take to go to court over a dui charge? It has been over 5 months since the charge.
Was charged with a dui in march, was appointed a state attorney, it has been over 5 months and no word on a court date. Is there anyway this case could just disappear?
You stand charged, but not convicted. You should be discussing this with your criminal defense attorney. If you are...
Can a YOA expungement be used even if a conviction for DUI occurs? South Carolina
I was convicted 6/2005 (charged 2/2005) and completed supervision 8/2007. I was then convicted for DUI 8/2008 (via failure to appear). From what I surmise it looks to be an expungement is not valid in my case. Would hiring a lawyer help in this situation? I understand there may be more cost involved but would this even be a valid option at this point?
Unfortunately, In SC DUI is an offense that cannot be expunged. If you pled to something different than a DUI then...

What is the possibility of getting a DUI out of state without being under the influence?
My dad recently left Nevada and flew to South Carolina, because my aunt died abruptly. On his second week of getting her affairs sorted, he was pulled over for a tail light (not reckless driving). He had to take a urine test after blowing .00 for alcohol. My dad uses marijuana regularly for medicinal purposes because he is disabled veteran, that has PTSD and has had 3 strokes. I read that regular users may have the drug present in their urine for weeks despite not taking any drugs. He hasn't done anything drug related within the last two weeks since he left. He has never been charged for anything. Do you think the court would be slightly lenient considering the circumstances? There was no time for the drug to completely leave his system, he has approval from a legal state, and has no prior charges.
If he hasn't been charged, he probably will not be.
Can I get life in prison as a habitual offender due to driving under suspension or DUI?
I was picked up with a warrant stating I am a habitual offender with possibly getting life in prison. I don't understand the charge. I remember getting tickets and that's about it and my license is suspended.
It is unlikely that you would get a life sentence, but a habitual offender faces serious charges if convicted. You...
