Hello I hope I can explain this correctly. I currently reside in a recovery home per serenity house j. Addison il, and the reason I'm bring this up is I'm trying to apply for a restricted drivers license.. I was told by an attorney I wouldn't be granted a restricted drivers license because I was convicted of driving whole my license was suspended. I initially received my DUI on January 2010.. received a 3 years statutory summary suspension per dupage county.. than that following august I was pulled over and was later convicted while DWLS on September 2010 per cook county.. is there anyway possible I could reopen that conviction case and get re sentenced to possibly lift that conviction?? I hope I didnt make this sound too complicated..

I received a DUI in 2007 with a judgment of 18 months Court Supervision. I did not commit any other crimes during that period but was unable to pay the fine. In 2009 I received a 2nd DUI and a Conviction with Probation was entered, and completed, but was unable to pay fine. My abstract from the Secretary of State's Office does not have the "Failure to Pay" listed under the DUIs but shows 2 convictions instead of 1, showing an initial revocation of 2 years, an an extension of revocation for an additional 3 years. How can I present a technicality of 1 DUI conviction and that I served the mandatory revocation for a full license reinstatement in a formal hearing?

First time offender. Very polite and respectful when doing all the officer asked of me. He told me that he had written the ticket as a "village ticket" rather than a "County" and that this would help me in court. I was charged with driving while license revoked. I was sentenced in march and got out in october. This was my first time down. Upon my release i had no stipulations and signed my MSR. Since then i have complied with my release. Calling when i am supposed to. Being respectful and never droped dirty. They just put me on home montering 2 weeks ago. The agent stated now i have new orders from the parole board. How is this? I have called more than a half of dozen people that where with me in the IDOC and they are infact not on home montering. Why have they done this to me? Can i do anything to contest or appeal this?

When I was 18 years old I was convicted of 3 DUI's. 2 in 1991 & 1 in 1992. Was convicted in 1996 on 4th DUI. All were misdemeanors, and I completed all requirements. I went through formal hearing process and my license was reinstated in 2007. Unfortunately I relapsed and was arrested for DUI again in 2012. It was written up as DUI 4th or more and I was charged with a class 2 felony and given 3 year prison sentence. I was let off parole early and have been sober and active in AA since my arrest. Do I have any chance of obtaining driving privileges of any kind? I plan to move to Florida within the next year or so, and hope to be able to drive in that state at some point. My son refused to blow. The discovery dash cam video shows ONLY HIS FST. He did fairly poor on the FST. A long explanation, but a full dash cam would likely aid the hit/run defense as son was on the scene with his car when the police arrived. The other driver did not speak English, 3 squads, 4 witnesses, 4 officers & lots of confusion that would likely be cleared up by a full video. As of today, we don't know if the entire videos were not given at discovery or if they don't exist resulting from the officers only activating for FST. I already have rule 411, Kladis, law on State Police cams, Webster, Strobel, & Schmidt. Looking for: case law dealing with officers obligation to turn video on (i.e. "cherry picking the use of video") and case law supporting motion for extra discovery. Thanks
