I received a DUI in 2007 with a judgment of 18 months Court Supervision. I did not commit any other crimes during that period but was unable to pay the fine. In 2009 I received a 2nd DUI and a Conviction with Probation was entered, and completed, but was unable to pay fine. My abstract from the Secretary of State's Office does not have the "Failure to Pay" listed under the DUIs but shows 2 convictions instead of 1, showing an initial revocation of 2 years, an an extension of revocation for an additional 3 years. How can I present a technicality of 1 DUI conviction and that I served the mandatory revocation for a full license reinstatement in a formal hearing?

First time offender. Very polite and respectful when doing all the officer asked of me. He told me that he had written the ticket as a "village ticket" rather than a "County" and that this would help me in court. I was charged with driving while license revoked. I was sentenced in march and got out in october. This was my first time down. Upon my release i had no stipulations and signed my MSR. Since then i have complied with my release. Calling when i am supposed to. Being respectful and never droped dirty. They just put me on home montering 2 weeks ago. The agent stated now i have new orders from the parole board. How is this? I have called more than a half of dozen people that where with me in the IDOC and they are infact not on home montering. My statutory summary suspension on the 2nd DUI was originally for 3 years, ( I refused breath test ), 7 months after my 2nd DUI I was pulled over while DWLS (driving while license suspended) resulted in a conviction, I was told my license won't be eligible for full reinstatement until 2019,and obviously my summary suspension was extended when could I possibly get a restricted drivers license? My brother has 5 convictions and 1 supervision, not sure there is a difference between the two. The prosecution is charging him with a class x felony, the dui's are the only thing on his record and he's never been in an accident. He has anxiety, alcohol and depression issues and is on lots of medication, which is obviously no excuse, but I'm wondering there are any ways to reduce this to class 1 instead. Our lawyer who represented him last case has said there is nothing he can do.

In 2007, I was arrested for 2 misdemeanor DUIs in different counties within 2 mos of each other when I was 18. I went to court for 2nd arrest 1st & was sentenced to probation, fines, com service, impact panel, & classes. Then at court for 1st DUI arrest, public defender told me I should have been offered supervision for my 1st offense because of Illinois DUI laws & mandatory sentences per DUI. I asked 4 jail time instead of probation because I was homeless & would not have any $ to pay for fines. Also had probation in a diff county revoked two different times for a misdemeanor destruction of prop&underage drinking charge when i was 17 for failure to pay fines & court costs/fees, but was given the exact same sentence as my 1st DUI.
