I was arrested for reckless driving taken to the station were I refused owi testing due to my Miranda Rights, is that wrong?
I was all ready "in custody" under arrest and had been taken to the station when they started asking me questions and I refused to be tested, asked for a lawyer.
If they ceased questioning after you asked for a lawyer or if they don't use any statements you made after that, there...
We couldn't find anything for I failed my intoxalock in Iowa, not a rolling retest, but the first blow of the day.
This didn't result in a lockout, so am I ok in relationship to the DOT? I actuall failed twice thinking it was a fluke and then just gave up and walked to work.
It depends. If the DataMaster DMT at the police station or jail did not accept the sample, the officer could have...
If I plan on automatically pleading guilty do I have to hire a lawyer?
You do not have to hire an attorney if: 1. You do not care about any potential defenses you may have. 2. You...
I'm from Illinois and I received an OWI for marijuana in Iowa. I'm just trying to keep my career from being jeopardized by this. Are there any plea agreement opinions besides OWI prosecutors are willing to accept to prevent reporting a DUI to Illinois? I can not lose my license due to a suspension right now!!!
Yes, it is mandatorily reported. Your license will automatically be revoked in IA, then an abstract will be sent to...
Friend was picked up for 3rd OWI. Sentencing is 5 years in prison with the comment ""DCS supervision pending assignment in OWI continuum". What does the comment mean?
It means your friend is in custody of the Department of Correctional Services until a space opens up in the OWI...
Can I get my Public Intoxication and Use of a Fake ID to Acquire Alcohol by a Minor removed from my record?
I was arrested while on a friend's vacation at a bar in Dickinson County Iowa. I spent the night in jail and couldn't see the judge until the next morning. Being on vacation I didn't have the money to get bailed out at the time and I just wanted to leave; so I plead guilty and was let go and just had to pay a $350 fine for each charge (Public Intoxication and for having a fake ID) at a later date. I paid them both and they are both on my record now. This occurred a little over two years ago when I was 19 and I am currently 22. I am wondering if there is any possible way to get either of these charges removed from my record, and if there is how would I go about it? Like I said the arrest occurred in Iowa and I am from Missouri so I'm not really sure how I would go about this.
I'm not an Iowa attorney but I'd be surprised if you're not out of time to appeal. Most states have strict time limits...
My employer hired a company to clean and wax the floor. They came to work drunk, spilled soapy water all over. Can I sue?
Stuck inside, bored so I thought I'd ask.. My employer hired a cleaning company to clean and wax the floor. They had been drinking, because my employee told me, after the fact, when the cleaner came through her line and bought something, she could smell alcohol on his breath. She thought I knew it. This happened overnight, and I was the only employee there. They spilled soapy water all over, the employee was upset he couldn't buy cigarettes. He was yelling, we can't get any f'n cig's. I picked up my pace to head to the back room, as I am looking over my shoulder, to see where he was, I slipped on the floor and tearing rotator cuff and cartilage in my knee. They were working 18 ft away from where I fell, so that hall shouldn't of been wet Can I sue the company they work for?
You have a workers compensation claim with your employer and should be getting all of your meds paid by them. In...
