How do I get a DUI from 2014 expunged from my record in VA?
I received a DUI after leaving my residence in a hurry and to save my life. I was being severely abused by my husband and we had a daughter together. She thank goodness was at my parents house, I dropped her off there Friday night. I went back home Friday night so I wouldn't alarm him and so I could pack up our things on saturday and leave while my husband was gone. It was saturday afternoon and my husband left as usual to go work out and he was usually gone for 3-4 hours on those days. So I had a plan to leave while he was gone so things wouldn't esculate again. I had a broken rib and in pain from his prior attack. I had a few glasses of wine but wasn't planning on driving anywhere. I was packing things up very quickly so I could leave with my father when he arrived in that hour. However, my husband came home early (as if he knew I was leaving) I was upstairs packing a bag and he attacked me again, threw me down the stairs. He was going nuts and yelling, I saw my keys by the door and grabbed them and left running from him. He chased after me, but I managed to get in the car and drive off. I was going to my folks when I slipped on ice and hit a parked car. cops came?
You don't say whether the case is still pending or has been resolved. In order to be eligible for an expungement the...
How is drunk in public defined in Virginia?
It is a crime to be drunk in public. If my friends and I get drunk in a bar, would that be a concern? I know bars are private property, not public property.
§ 18.2-388. If any person profanely curses or swears or is intoxicated in public, whether such intoxication results...
How to handle a drunk in public charge with your employer
I was recently charged with and arrested for drunk in public. I'm in the process of hiring an attorney to hopefully have this expunged. This is my first offense and I was a passenger when our car was pulled over and couldn't find a safe ride home therefore I was arrested. I am terrified to let my employer know as I work for a local government agency. The employee handbook does not state that I have to disclose this - specifically. It does state that if you're charged with something that could affect the community's opinion of you that you could be suspended and investigated. I work in a different locality than the one I was charged in but am still TERRIFIED that this could get out and I could be fired. I would rather keep my mouth shut, go to court, and hopefully have this dismissed without anyone finding out. Everyone I've spoken to outside of my job that I can trust has told me not to say anything and that admitting this what I consider to be a private matter could do more harm than good. Please help me!!
To suggest that the employer will not find out is ridiculous. You work for the agency of the government. The...
Virginia. Sealing a DUI.
So my year probation/suspended license is coming up in January. I do not expect to get my DUI expunged, I didn't think I would be above the limit, (I literally offered to take a PBT when he didn't think I was intoxicated but of course figured sure, let's do it to make sure) however.. I was above the legal limit and I'm serving my time for that. I take responsibility for what I did even if I didn't mean to. I was guilty. My probation included: 6mo of Interlock (finished with never blowing above than 0.00BAC) 20hrs of ASAP classes (with a glowing review from my instructor) And paid my fines and fees on time. Can I apply to have the record "sealed." ? I will do just about anything to hide this from potential employers amongst other things. I don't know this is a thing but I'm 100% fine with the Judicial system keeping the record in the event that I did it again because I won't, but I'm about to move with my husbands job transfer and I don't think I'll be able to find sustainable employment there with this on every background check. Any info on sealing (I'm aware expungement is out of the question) would be much appreciated!
Sorry, I doubt it. Most states do not even allow deferred probation on DWI. Congratulations on completion. MADD & SADD...
When a minor takes a drug test for employment does a parent need to be present?
My son took a drug test with me present. The next time he went in I wasn't there and they made him do it again I was not notified nor was I present. I feel this is not right.
II'm sorry, but I don't understand your question. Are you asking whether your child has broken some kind of law or...
Interlock violation-I missed a rolling retest. Had been arguing with teenage son. Tuesday
Called VASAP right away. Running late went to punch in. Time went from 5 minutes to two minutes. Locked out. Panicked bad. 85 days suspended over my head. LabCorp is on my way home. Went for 80 hour test. Need Drs. note. Went a different way home next day, Wednesday, to stop at another lab. Got it done. Negative. Caseworker said to just go clear it with interlock place. She would send me a letter if there's a problem. I have the test results. Will that matter? I knew I couldn't wait until Saturday (Group Therapy) to long. What happens now?

How can I make a compelling case for the dismissal of or reducing a DUI?
I am a 36 year old mother of 4, married, licensed social worker who was out for a friends birthday. I rarely drink (or go out) but I did on this occasion and ran a red light. I was stopped and complied with the officer on completing the field sobriety test and breathalyzer (i think it was .127). I was arrested, charged with DUI and blew a 0.1 at the station. No criminal record, good driving record ( positive 2) and this is my first DUI. My youngest child is 1 years old and I have recently lost about 30 pounds. Don't know if this is significant to the case or not.
You're going to need a lawyer to help you in court. DWIs are both technical and scientific. They get very complicated...
