Car accident,only me involved.tested positive for several drugs when given urine test at hospital.Chances of omvi conviction?
I wrecked my car by myself,no else was involved,no passengers.i was taken to hospital and tested positive for amphetamines,opiates,cocaine,alcohol and thc. in a urine test. all drugs were taken more than 24 hours before except 2 alcoholic beverages several hours before crash. no blood test or breathalyzer was administered only urine test.talked to cop at hospital gave no statement told him no information except i lost control i wasn't from the area.he wants to charge me with failure to control which i'll accept but also an omvi.what are the chances of him getting an omvi conviction? still have not been charged nad yet to give official statement.Officer called me recently. I never went to court for a DUI. I have ALS(administrative license suspension). When ALS is over can I get my license?
I recently got a DUI and I didn't go to court. The DMV requires one year of ALS and a $450 reinstatement fee. When I have met those requirements will I be able to get a driver's license in another state or can the state I got the DUI in block me from ever getting a drivers license again? If they can block it forever, is there anything a lawyer can do to help get my license(short of me going back to OH and serving whatever my sentence would be) Got the DUI in OH and I'm now living in PA. Effect of Hospital records from emergency room doctor in OVI refusal case.
Refused to submit to blood draw at hospital over 2 hours after car ran off road and I hit my head on steering wheel. Hospital records from emergency room doctor indicate: "not clinically intoxicated" and "no nystagmus". Trooper arrived on scene after car ran into a ditch, claimed there was an odor of alcohol, while I was in emergency vehicle. Transported to hospital. So, two days ago now I was issued a criminal complaint for underaged drinking. I am scheduled to go to court on June 16th and I am now 18 years old. Additionally, last year (when I was 17) I was arrested for drug paraphernalia. I completed diversion and had that sealed and nullified. However, now that I will again be in the legal system, will my past juvenile record influence the consequences? Should I expect jail time? If not, what fine should I expect and should I expect community service? Additionally, seeing as I was intoxicated, I wasn't completely sure of what story I was telling the officer about how I obtained the alcohol. I was in my car in a parking lot and a beer had exploded in my car earlier that night and I had 5 beers in my back seat. A police officer smelled the beer and asked the 17 year old in my car to get out, then he saw the cans. I was taken to the station and kept there for a few hours. The police officer said that the court often sees 18-20 year olds coming in for this charge and they normally let them go the first time, but I'm unsure if calling my lawyer is necessary.
