Husband arrested for DUI - now what?
My husband was arrested in our driveway for DUI - he was sitting in the driver's seat with the vehicle running. He took a breathalyzer test onsite and blew .163. He was taken to jail and released to me a few hours later with no paperwork. They did not take his license, nor have we received any paperwork for what he will be charged with. What is our next step? Do we just wait for paperwork to arrive in the mail? I assume he is safe to drive until then? This happened on Saturday night, it is now Wednesday.
I would not wait for anything. The fact that he was taken to the jail likely means the process will be beginning for...
What should a first time offender expect in a DWI charge?
Is the punishment more severe for those who have crashed their vehicle (no other cars involved) versus those who are simply pulled over? Can a judge says that .15 is close enough to twice the legal limit and treat it as such? What can a person with a clean driving record expect to have happen?
A crash case could potentially be handled differently by the prosecutor and judge. There may be several legal issues...
Will I be charged with a DWI?
My car's steering went out while I was driving and I was able to maneuver it to the side of the road. I walked to the nearest restaurant/bar to call a friend to be picked up. I had a couple beers while waiting. My friend arrived and drove me home. I again had a couple of beers. Then the police showed up at my residence to inform me of towing my car. They gave me a breathalyzer test, which I failed and gave me a ride to the police station. I was given paperwork for revocation of my license. This happened on 4th of April and I still have not been charged. Will I be charged and how long does that process take? I have called Sherburne County but keep on being told I have not been charged yet. I need my case to be heard. I am unemployed and now I cannot even look for a job!
You have a defense of post driving consumption. Unfortunately, you only had 30 days to challenge the revocation of your...
My driver's license was revoked for failing to pass a breathalyzer test in my driveway.
I was not jailed or to date (2 months later) been charged with a DWI. The papers I received just state I must pay a $690 fine and re-take my drivers test. When I called the DMV they said my license was revoked for 2 years. How can this be?
I would call a lawyer today for a free consultation there is much to discuss
I received a 3rd degree dwi with a bac of .303, it is my second one. what is the possibility of a lesser charge?
i was recently pulled over with a bac of .303 and charged with 3rd degree dwi. it is my second one in 10 years. i am curious, with an experienced lawyer what could my charge possibly be reduced to?
With a blood alcohol level that high, more that three times the legal limit, and a second offense, chances of the...
If a car is forfeited, is there a way for the owner to get the property back that was inside?
BF was jumped while waiting to sober up and drive home. Got injured. Was getting his car vandalized. Drove his car out of parking ramp and across road to parking lot to safety because he couldn't defend himself with his injuries. Locked it up. Walked away and called the cops. Attacker came back and attacked again. BF got brought in for a DWI after he went to the hospital. He cooperated the whole time even though he felt like he was being treated like a criminal and then refused a blood test because he already gave them everything else. He did not know this meant forfeiture of his car. He has a lot of belonging in the car though... Thank you!
Yes you can make an appointment through the police to get personal belongings out of the vehicle. From these facts...
Does a sheriff need your I.d and insurance information on site ? dui? car accident?
Got arrested two weekends ago, blew a .09 after crashing my car and totaling it, didn't get asked for my drivers license or insurance info, but now the sheriff is asking for it through email? do i give it to him? isn't that unprofessional? also I blew a .07 45 minutes later at the station, I am not making any excuses for my actions, BUT i have a clean driving record prior, no tickets no NOTHING. I drank, 3 beers and 2 shots of vodka, and got extremely ill which is unlike me, got sick, and honestly just wanted to go home, 5 minutes from my house, fell asleep and then crashed my car, is there any way to even handle this, would a public defender even be able to help? I NEED ADVICE.
Do yourself a favor and get an attorney right now. AVVO, the state bar, and other websites will help you find a DUI...
