also once the intake process is over and they get classified and have to do therapeutic community. what does all this entails and when are they eligible for parole or early release.
You might be eligible for a program, depending if the judge approves it.
I have had some serious problems in the last few months as I have been arrested twice for DUI, once in Del and one Chester County, PA. Leaving aside my terrible judgement during these 2 incidents, I am curious as to how the DUI's will be treated. Due to their closeness, my attorney believes they will both be treated as 1st DUI offenses, with the DMV recognizing that I do in fact have 2 DUI's on my record and treating it as such. More specifically, in your opinion, am I looking at a year suspension for the first offense and then an additional 18 months for the second as it was a 3rd tier, or will there be a different timeframe as they were so close together? Whatever the case, any idea how long it will be until I can apply for an OLL license?
I'm sorry, but if you have an attorney you need to direct all of your questions to him/her. It's unethical for me to...
I hit a telephone pole while drinking and driving, I did not leave the scene and was very compliant with the trooper but I do have the feeling I will be in the third tier for BAC, the trooper mentioned he will recommend me for ARD. I was the only person in the car and was not injured what are the chances of denial into the program?
Consistent with the Trooper's remarks, I would expect that you would be offered ARD, but I strongly recommend that you...
I received a 6 month probation sentence for a DUI. My first question is in regard to minimum supervision; as she stated I'm categorized as low risk. I'm one month into the 6, and am not scheduled to meet with her again for another 2 months. I'm just not familiar with that term and was hoping for some clarification. Additionally, I've paid off my fines, successfully completed the home monitoring, completed the AHSC required, and have finished 56 of the required 80 hours of community service. My PO said that once the community service is complete, she'll close my file. I understand that I'm still on probation, but what "closing my file" entail with regard to supervision, reporting etc?
It sounds like the PO is saying that she won't actively supervise at that point. You will just need to remain out of...
Court appearance pending and license NOT suspended. Can I get a new license when I move to another state?
I currently have a court appearance pending for a DUI in the state of AL that has been rescheduled several times now. My license was not suspended after my arrest and I still have my original license in my possession. I am about to move to PA and saw on their Out-of-State Driver's License application it asks if I have any pending criminal or driving charges. If I check this box and explain I have a pending DUI court date in AL will I be prevented from getting a PA license until it is resolved?
I wouldn't anticipate a problem obtaining a PA license under the circumstances described, but it will likely be...
my case was transferred 2 days before my arraignment in municipal court. Is this legal in New Jersey? It was transferred from municipal court to county without ever being arraigned!
Although you live in PA since the case is in NJ you need to consult with NJ counsel and post in the NJ forum.
I have had some serious problems in the last few months as I have been arrested twice for DUI, once in Del and one Chester County. The first arrest occurred in July, 2013 with the second occurring in September, 2013. I am curious as to how the DUI's will be treated. Due to their closeness, I've been told they will both be treated as 1st DUI offenses in both counties. My question arises from the fact that by the time of the trial/pre-trial hearing for my 2nd offense, I will have been convicted of the first DUI. I'm just worried that the court will see my conviction on my record, regardless of having committed the 2nd offense before being convicted for the 1st. Is this a valid concern or will they both, from a court penalty standpoint, be seen as 1st offenses?
The 2nd DUI had an occurrence date prior to your conviction date for the 1st, thus your 2nd DUI will be treated as a...
