Bellevue Law

I received a DUI conviction 3.5 years ago (1st time) and its the only thing on my record. The judge told me that he would defer it with the stipulation being that I kept my nose clean for 5 years and after that time it would fall off of my record. I just received an HOV lane violation which is a moving violation in my state. Will that affect my deferral?
Unless the judge took the very unusual step of ordering that you have no civil traffic infractions you should be fine....
I had a prior DUI back in April 2011. I chose to go with a deferred prosecution to stay out of jail. I also completed 2 years of treatment and took AA classes. Finally finished treatment in June 2013 and everything was going well until one night, I went out celebrating with a co worker and didn't use my signals to turn. So I got pulled over and the officer asked if I would do a sobriety test, so after having a a couple of beers and a big dinner, I thought I was sober enough so I decided to do it and blew a .05. The officer gave me a ticket and now I picked up a new charge for a negligent driving 1st degree. What will happen to my deferred and is there a way to not get it revoked?
You need to contact an attorney immediately. You can contact the attorney who represented you on your DUI or hire...
I was stopped took a breathalyzer test which showed .055 and was listed as so on the ticket. The charge on the ticket was DUI even though my BAC was will below .08. How is that possible?
You can be charged with a DUI with any breath test level under the "affected by" prong of the statute. These are great...
Hello, I got DUI on Sept 2009, I had paid the fine and completed the 2-days working in goodwill on 2/24/2010. However there was 3-yrs probation. I filed an expungement on 2013 and the case was dismissed on 4/12/2013. My first N-400 application was denied on March 2010. I understand there is a 5-Years GMC. Should I reapply 5-yrs from the completed probation date or 5-yrs from the date application got denied? Can I reapply Now or should I reapply on 4/12/2018? Thanks so much for your help and info. Note: I used to live in CA and have moved to WA state since 2011.
It is five years from the day the conviction happened. Since you completed your probation, you can reapply already but...
I was pulled over by a police because i made a wrong right turn. The road was very confusing with 3 long yellow road curbs to separate the opposite directions. I turned on the second yellow curb and then realize it was still for the opposite direction. It was dark with no other cars..the police pulled me over and i did the soberly test, after that he just read the rights and then arrested me, saying that i was intoxicated. I arrived at the police station and blew 0.086. I am worried that the record will affect my future job application and work visa for another country.. What is the percentage of lowering the charges down based of my information? And what could it possibly be lowered down to? Thank you
You certainly should contact a DUI attorney. Many law offices, including my law office, offer free consultations and...
I am charged with both DUI and Reckless Driving at the same time, i understand that DUI may or may not be reduced down to reckless driving or negligent driving. But how about another reckless driving violation at the same time? can a person be convicted with two charges at the same time?
To answer your first question, the possibilities are almost endless based on the facts of your case. As for your second...
Two months ago, my fiance got a DUI. He has been in the country for over 12 years and this was the first time he has been in trouble with the law. A week ago, he was pulled over for a "dim light" over his license plate. He was unaware that his license had been suspended just days before and he was arrested. My fiance was taken to a local jail where they put an ICE hold on him. I was told that I could not post bail. He is now detained by immigration. In a case like my fiance's, is it possible to avoid deportation? I am willing to do anything I can to keep him here, but unfortunately my financial situation is not the best- I am a full time student and work few hours. Does anyone know of attorneys who work on a sliding scale initially? Once he is out and working, we can afford to pay more.
There are number of ways to avoid deportation. A lawyer that will be representing your fiancee needs to talk to him...
