What should I do in the case where I was arrested, but not charged, for a DUI and my license was suspended?
I'm the primary caregiver of my kids and need to drive for work. I made a horribly dumb mistake, but have a spotless record otherwise. Also, my work takes me to Canada...will I be denied entry at the border if I was not charged? Thank you.
You should contact a DUI attorney right away for a free consultation to discuss your case. Many times there is a delay...
Parenting plan example verbiage re: DUI/Drugs
I am creating a parenting plan proposal with my sons dad. He has a recent DUI pending court; I am looking for example verbiage (King County/Washington State) that would address this in our parenting plan so to protect my son in regards to transportation and behavior while in his father's custody.
You might consider some language like this: 1. The father shall not consume alcohol any time the parties' child...
In the process of renewal of my DACA, I was arrested for DUI. Should I do a deferred prosecution?
I was arrested for DUI during the process of renewal of my DACA. If I choose to a deferred prosecution, would that give me a chance of getting my DACA approved later down the road?
It depends upon what exactly happens when prosecution is deferred in the jurisdiction where the DUI occurred. Many...
Green Card and DUI Abroad with ongoing trial. Still need final court dispositions?
Hi, I was charged with a DUI 4 years ago in Italy (I'm italian). No other DUIs or any problem with the law. 2 Years ago I applied for L1 VISA. I disclosed the DUI and was requested to attend a medical examination. After that the L1 was approved. My company is now sponsoring me for the Green Card. The trial for the DUI in Italy is still ongoing. 1. Will USCIS want to see the final court dispositions even if the crime was committed in Italy? In Italy statute of limitations applies from the date the crime was charged/committed. It will be reached on May 2017 and I'd get an acquittal. 2. Would it be better to wait that long or accept a conviction if it comes earlier to have the final court dispositions available? 3. Is there a way I can get my GC before the trial ends in Italy? (My italian lawyer has power of attorney) Thanks, Francesco
This is mainly an immigration question. It would be best to have a full discussion with an immigration lawyer.
Would a Deferred Prosecution help my pending DACA renewal get approved or are there any other options. I have a DUI
BAC was above .15. My first DUI. No criminal history.
You shouldn't do this on your own, but USCIS have been allowing expunged/probation complete DUI at their discretion....
I got convicted for DUI , gave lawyer 3000 & did not win the case, now want to terminate my probation and he is asking more $$$?
Just to file a motion with the court to terminate my probation, my attorney is asking for more money. I have already paid him 3000 for the case he did not win and again more just to file a motion seems ridiculous? any advice would be great!
Your answer will depend entirely upon what your contract with your attorney stated. Most criminal engagement agreements...
Can i enter Canada with DUI (No Charges filed)
Almost 2 years ago i was pulled over for DUI and was arrested. I went to the station and took the breath test, where i blew under the legal limit. I was released the next day in terms that i would get a court date later on. i still have not heard back from the court. what i know: My Drivers license has not been suspended or have any limitations. I was able to leave and enter the country, so no warrant our for my arrest. I have ran a background check on myself and it states that there has been no charges filed against me. (just arrest record) Am i able to enter Canada without being denied? or should i wait another 3 months when my statute of limitations expire and then try to enter Canada?
An unfiled DUI charge should not cause you to be inadmissible.
