Is it required that the state (courts) informs us that pleading Guilty to a DUI could lead to a HTV status?
When i plead guilty to a DUI I was not inform that it could possibly lead to a DUI if i have 9 moving violations and 1 major in a ten years. If i knew this was possibly I may have not plead guily. I was told that there is case law that the supreme court over turned the conviction since the judge did not inform this to them at sentencing. Was wondering if this is true and what is the chance of getting this DUI conviction overturned?
Most plea agreements in Indiana contain a waiver of rights as part of the body of the plea agreement. Part of that...
Can I have my D Felony removed from my driving record which requires me to have an SR-22 from conviction in November 2011?
My driver's license is currently suspended because I have to have an SR-22 and my insurance rates are very high so I just don't drive. I was convicted of a D felony for possession of a controlled substance involving a vehicle and have already successfully completed probation which allowed me to have it reduced to an A misdemeanor, yet it still shows up on my driving record as a felony. Thank you so much for your help, I've had a lot of trouble getting a clear answer on this.
Misdemeanor sentencing isn't automatic. Take a copy of your reduces sentence to the bmv and the state police. I don't...
Sheriff says I ran stop sign. I did not. Got OWI but did not run stop sign. Video didn't come on till I was through the turn w/blinker going and headlights on. I turned onto the street I live on when I saw lights flashing behind me so pulled over turned my lights off. 2nd officer pulled up to 1st and said "you got him" 1st said "yes" and 2nd left the scene. Video shows 2nd pulling in front of my car and getting out of his. Did not happen & not in the report. Video tampered with, video does not match report. 2nd not in report because it did not happen. My public defender keeps rolling over for the sheriffs Dept. Took 6mths from last Nov to get video. Now working on 10ths. More details of other unethical things this officer did but do not have the room to put it all on here. Please HELP
If the video showed you didn't run the stop sign, that would be great. But it sounds like you are saying it simply...
