Probation breathalyzer violation follow-up question
Can NyQuil result in a BAC level of 0.11 on breathalyzer? And if not that, how about a BAC of .084? Or would proprietary ingredients in NyQuil be able to differentiate that from vodka anyway? I am currently on probation for DUI, with breathalyzer tests Frequently during the day. Does a breathalyzer have any way whatsoever to distinguish NyQuil from vodka? I realize they are both alcohols, but could it differentiate by using proprietary ingredients of the brand in NyQuil which would not be present in vodka for example? Would a BAC as high as 0.11 be inconsistent with NyQuil and rule it out if assumption was made that at that level, toxicity from nyquil's other ingredients would be present (acetaminophen for example)? Could the two be differentiated by increased liver function tests, which NyQuil causes, And if so would that be routinely requested by probation officer as follow-up? In short, is there ANY way that a breathalyzer could reliably distinguish NyQuil from vodka given a BAC of 0.11 or .08? Iis that in ANY way legally defensible?
If you specifically want this answered you should consult with an attorney in UT about hiring an expert to answer this...

On a second DUI, must a person reveal a first DUI to the courts (or to their lawyer) if the first DUI was expunged?
My wife received a DUI 13 years ago in Utah. It was expunged a few years back. She recently received another DUI (with a bac over .2 ) in Nevada. The lawyer we retained in Nevada asked if she had ever had a DUI and she said no. She told me she didn't have to tell the lawyer or the courts about the first DUI because the first had been expunged. Is this true? What are the consequences of not saying anything about the first DUI?
True, but not smart. You should always tell your attorney everything so they can protect you from an attack. If the...

What should I do to keep my license after an alcohol restricted driver citation
I got pulled over and received a alcohol restricted driving ticket in utah (im under 21 years old) it will be my first offense, Im curious if my license will be suspended or revoked and if my car insurance will be affected and what I should say when I appear in front of the judge. I drank less than a full beer an hour before getting pulled over. I was pulled over for an expired registration, the officer said I didnt seem impaired and the only reason he asked for a BAC test was because my friend left a beer box in my car.
Yes, yes, and not guilty. Get in touch with a DUI specialist in your area immediately.
