I was never ordered to have an ignition interlock by my judge. I have a DUI (first one) I have never had a license so when I got my DUI I figured it was long gone anyways. Drove to a gas station got stopped and was arrested for revoked license and Operating vehicle without IID. I've checked with my probation and the judge never ordered me to have one. Where is this coming from?
DMV. It seems like the judge missed the ignition interlock device on the final disposition of your case.
I was arrested for DUI in 2011. I wasn't treated with respect while in police custody. I refused the chemical test.
A warrant was served on me. I asked to speak to an attorney and several officers attacked me and threw me on the concrete ground. I was denied my request for an attorney and kept in a small cell for several hours being laughed at by a woman officer. I was also denied food and/or drink and wasn't allowed to use the restroom for hours. I also was never read my Miranda rights. I retained an attorney, told him everything ~ Justice was not served. My life is ruined. I need help. This is only the "tip of the iceberg"
So far I am not hearing any facts to suggest a defense to DUI charges.
I live in Utah and was convicted of a DUI in 2010, i completed a Prime For Life course and the court copied my certificate for proof. I am wanting to get my drivers license back and the DLD needs proof. I have since lost my certificate and the location i did it at didn't keep a record for some reason. So the only proof i have is the copy that should be on file for my DUI case. Is there any way i am able to request a copy from the court?
It should be available as part of the court docket and on exchange. Just go into the court clerk with your case number.
I had a blood draw for driving irratically. It says on my summons 0.08 grams, but I haven't had any alcohol since 1970!
I wasn't arrested, and I admitted to taking prescribed pain meds per drs orders. I don't know what to do to being accused of drinking
You need to contact an attorney at your earliest convenience. Even though the charge says .08, It will most likely try...
I was drinking the night before and the next day try to start my car I failed three times I stop and than a few hours later I was able to pass. I told my Porbation officer about it I have to meet with him. I'm worried about going to jail I haven't had a drink since that night. This is my first time messing up and I have done everything else the courts have ask me to do.
You should consult with your attorney that did your DUI case. They will be in the best position to answer your questions.
I am scheduled to fly out of the country in a few weeks and I have a bench warrant for a DUI- failure to complete community service and pay the rest of my fine. I have tried to pay the fine, but have to appear before they will let me- and i have some hours completed. I have a court date scheduled, but they couldn't get me in before my trip. The judge was booked. I can't afford a lawyer or I'd do that. What can I do to ensure that I can leave and return and make my court date without being arrested??
No you do not want to fly as you will likely be detained for some period. Hire an attorney to lift the warrant.
How long does the court have to file a Class B Misdemeanor, before I am able to move for a dismissal? (Statute of Limitations)
This is a DUI Case. The incident occurred several months ago. I've been contacting the courts at-least once every week to get a court date, and so far, have had 0 Results. One of the people I spoke to on the phone told me something to the effect of; "If the State takes longer than 90 days to file a case, it usually means they don't have a very strong case against you. So, if they take longer than 90 days, you can usually move for a dismissal." I've also heard a few things about the Statute of Limitations, but I am not too familiar with the laws/regulations surrounding the topic. Can anyone please elaborate on either of these topics? Any advice helps. Thank you.
The statute is usually 2 years for a Misdemeanor. If they haven't filed it could mean a lot of things. It could mean...
