How do I get a dismissal on a dui that I received when I wasn't under the influence of anything ?
I was driving home after picking up a friend from a hangout I didn't realize he had a beer in his shorts but he did. I fell asleep behind the wheel after being up for so long and wrecked in the ditch. When I woke up I got out of the vehicle to find myself barely able to walk from pain to my leg and having everything seem like it was spinning due to an impact to my head. When the ems was asking me if everything was okay i said yes to avoid going to the hospital but I really wasn't. So I think the officer thought I had been drinking because he saw a beer, I could barely walk and I was acting weird, but come on I just wrecked pretty bad. When I received my citation it was for speeding which I wasn't and also for dui under age which I was definitely not under the influence of anything. I never took any sobriety tests nor breathalyzer. Now I dnt know if I should hire an attorney because I have a court date next week for something I honestly didn't do and I dnt know what to do. Please help?
Hire an attorney and request a trial. If your passenger is willing to state under oath that the beer belonged to him,...
I want to take my ex to court to get custody of our 16 yr old child due to here getting a DUI with him in the car.
I want to take my ex to court to get custody of our 16 yr old child due to here getting a DUI with him in the car and going to jail. The problem is it happened a few years back and she has had it "Expunged " from her record. Does this mean a Judge cannot use this evidence of child abuse/ endangerment? Thanks in advance.
If the incident is a few years back, it may have waned in relevance to the best interests of the child. More relevant...
What does the "M" means when charged with DUI 3RD/M?
My friend was charged with a DUI 3rd which is considered a felony. Before going in front of the judge for the DUI 3rd his attorney went to the judge to close the case on the DUI 2nd and he stated it was dismissed. My friend ended up taking 5 years incarceration over 7 years of probation. I'm just curious to know could the "M" means misdemeanor or is it still a felony charge. Thank U!
The name depends on the computer filing system used in the county where the case was filed. My guess is it stands for "...
Can I get a Misdemeanor Class B DWI off my record so that I can teach in Texas?
I was convicted of a Class B Misdemeanor DWI in 2011. I have never been in trouble before or since, I made a mistake and ended up hiring a horrible lawyer. In the end I was charged with the DWI. Is there anyway to get it off my criminal record. I would like to try to have a career in Education. Is there any way possible to do so?
A DWI conviction will be on your record forever, but it is NOT a bar from teaching. I've seen plenty of teachers get...
In 2 yrs I haven't received notice of my dwi surcharges. Is there a statute of limitations? Have I possibly been overlooked?
This is my second dwi conviction. I will have all requirements fulfilled and released from probation on 8-2-15. If I have flown under the surcharge radar somehow I have no ethical qualms about not being required to pay the fees. One other concern I have is possibly tipping "them" off when I call dps to inquire about having my sr22 requirement terminated.
Yes, there's a statute of limitations but you'd need a criminal defense attorney to search your record. Sometimes...
How does indictment work when you have pending cases?
He has a misdemeanor DWI (dwi enchanced in Harris county) in which he has an MTRP on that case, a felony 3rd DWI in Jefferson county, and just recently had a vehicle accident in which he was drunk in December but hasn't been indicted yet. Be does have court this morning so my questions are can the judge proceed without him being indicted for the new charge or will his court date be reset again? Also, he has not been convicted of his other charges because his court dates were reset with the other cases.
We may need some more facts to make a determination here. If he picked up a new charge, and it is a felony, then it...
