OVI - "red glossy eyes"
Hello everyone, I am being accused of OVI. The officer claimed when he stopped me that I had a "strong" alcohol odor, "red and glossy" eyes, and "slurred" speech. I can defend the slurred speech with audio from the cruiser camera, I'm not worried about that part. I naturally have circles under my eyes, could I use my license ID photo as proof of this as you can clearly see in my license ID? I have a scan of my license that was taken from when I needed to scan it for a job related purpose. I'm thinking my defense might be I had no slurred speech, period. The officer should have clearly known from my license photo I naturally have tired looking eyes. And as far as the alcohol odor... not sure, possibly my cologne? I'm working on getting an attorney to successfully represent me.
