The DUI arrest was botched by the police from the start, I wasn't even driving when they arrested me. I was in the car with the driver and my girlfriend when we stopped at a store. When i came out of the store the driver had fled. My girlfriend at the time was intoxicated and a violent person anyway, and of course we were fighting . I was the only one to go in the store and when i came out the police had arrived. I avoided the court and was eventually picked up because the same girl accused me of DV and that felony charge was totally dismissed. The DUI went like this: I was never shown the evidence and the words of the judge at pretrial were" if you take this to trial you WILL loose and i WILL send you to prison." Terrified i plead guilty. This judge was disbarred shortly after.

I was arrested for an OVI in September. I fell asleep behind the wheel and blew a .13. I was arrested for a second OVI on Defember 1. This time my wife began throwing up and drove down a side street. We were stopped at a train crossing and I told her switch places with me and I would just pull over to a gravel parking lot to avoid her having to throw up out of the window again. While waiting for the train to cross I fell asleep and a cop tapped on the window and I was arrested. I refused the breath test and pleaded not guilty per my attorneys advice. My first case is still pending and now I have this second. I have been ordered to wear the scram bracelet and counseling. Is there a chance the first be plea bargained to physical control and the 2nd to reckless operation or wet reckless?

I was pulled over because of a warrant I had out. I had just left a bar, but didn't think I was "drunk" so refused to blow (I have 2 prior OVIs) but was given a field sobriety test which I'm pretty sure I did well on. I was taken to the police station and told I needed to give a blood sample, but there were not enough officers to take me to do that so I never had to provide one. What do you think my chances of getting out of the OVI charge are since there was no breathalyzer or blood test taken?
