IntDrivResCen won't sign off compliance. I completed 16 weeks, no + urine screens, how can I go over their heads and appeal?
I got my 2nd DUI 7 years ago, in Monmouth County, NJ, and was found guilty in Federal Court because the DUI occurred in Sandy Hook National Park. I completed two years supervised probation, 180 hours community service, 48 hours IDRC weekend in Passaic, and 16 weeks of IDRC class in my county in 2010. I was in many programs (I had a drinking problem) but now returning to be in compliance for my license, sober, they keep referring me to more programs, now a 5 half-day a week program, which I have already done and would mean quitting my job and not be able to pay my surcharge. I have documentation proving I completed the initial 16 weeks and more. How and whom do I address this with? Do I appeal in Federal Court? Do I have a case?
Did you have an attorney? You needed one Did you accept the plea? If you did then you agreed to all this, and more....
I would like information on how to appeal an IDRC recommendation for another treatment program. I have paperwork documenting my completion of the 16 week program and subsequent recommended programs but Hunterdon County IDRC will not send my compliance to Motor Vehicles. I cannot seem to get answers or talk to anyone over County level in IDRC. I have been told I can request a hearing to appeal but since it was a DUI on federal property and tried in federal court I am not sure where to request it? The court I was initially sentenced in? And if so, how would I format the letter, what exactly should it include, and to whom exactly should it be addressed?
Your question is not clear. Are you in the military? Perhaps you need a military attorney? But at the very least, it...
Someone I know from nj had their license suspended for two years last year. Anyway, she was caught last week driving while under that suspension. She was arrested, but released later that day. When she appears to court, will there be a an automatic jail sentence ruled for that offense whether she is represented by attorney or not?
Only if you're found guilty
My son got a DUI in Briston PA. He passed all 3 field sobriety tests. Breathalizer= .102, bloodwork not back. What are options?
he has 3 prior arrests for pot, none resulting in loss of license or jail time, only fines and court costs
I'm pretty sure you already posted this. You need to post in for a PA lawyer.
I got a DUI when I was 17 and my BAC was .03%. When I was 19, I got a DUI with a .10% BAC. I only lost my license for 9 months, and I received no jail time or even community service. I recently received another for driving under the influence of my prescription Xanax. It seems that they treated my second one as a first since I did not lose my license for the mandatory two years, and I was not required to do community service. I am currently attending college. What are the chances that I will go to jail for this most recent offense? My lawyer seems to think that since I did not lose my license for two years the second time, the latest one will not be treated as the third and will not get jail time.
It is always best to listen to your attorney, and for that reason you should not be asking other people that are not as...
How many times can a superior court postpone a DUI appeal? If a certain amount of time has passed, can charges be dropped?
The case is regarding a DUI. The Officer lied about reson for vehical stop. It is visually evident in the video evidence.
Theoretically, maybe, if the delays were truly extraordinary and all due to the State's delays. However, practically...
Can a county Intoxicated Driver Program withhold driving privileges if the "driver" has fulfilled all obligations?
My daughter plead guilty to a DWI and has been without a license for 7 years. She was signed off on her 2 years' probation, went through rehab and has completed Intoxicated Driver programs, but the county IDRC administrators keep telling her she has to do more programs. How can she fight that decision?
Every time one of us answers this type of question about IDRC an unknown contributor chimes in and tell us we are wrong....
