Is Ambien a standard prescription drug that the GBI will look for in a Blood test involving a DUI under the influence of Alcohol
I was arressted for DUI for Alcohol. I submitted to a Blood test because the breathalizer was not registering anything. However, I did take Ambien and apparently woke up from my sleep and went for a drive (sleep driving) and then was pulled over which resulted in my arrest. I think I might have told the officer that I had taken Ambien but don't really remember. However, I would think that if I did tell him then it would have been noted in the citation but it wasn't. Only Alcohol was cited as the reason for the arrest and blood test.
If there is no alcohol on your blood and if the officer asked the GBI to conduct a drunk analysis, then the GBI will...
I was arrested for DUI in georgia in 2009 and the case was dead docketed. Arrested again 1 year later and the second time I was convicted. I complied with all of the legal obligations (probation, etc.) However, I got behind on my probation fees due to my inability to obtain employment. Wanted to leave GA to seek employment elsewhere. I elected to do the remainder of the sentence in jail so I could legally leave the state.. Now it shows up as a violation of probation. Can I get the VOP expunged? I was violated simply because I couldn't pay. My question is does the first arrest show up on a criminal background check as a conviction? I checked the county court records for the first arrest and it shows up as "closed" in 2010. (Dated before the 2nd arrest and conviction (no further activity)
The first arrest should not show as a conviction, and under Georgia's new expungement laws you should be able to...
I am a paraplegic who can't urinate on my own. I wear a condom catheter because my bladder spasms can i request blood test?
I am afraid that I will get in trouble because I smoked the week before court I got out of jail about a week and a half ago and have not heard anything from probation. I was told I would be given random tests and even told my lawyer that I had smoked recently he said he would ask the judge for an exception to wait 30 days to give me a chance to clean my system. I never heard this at my sentencing and was taken to jail. Can I request because I am unable to urinate on my own for a blood test? I cannot use catheters due to damage and pain but my bladder spasms and empties itself but mostly at night time.I am in a wheelchair and am deathly afraid of going back to jail. Anyone know if I can request a different type of test? I am also on pain management and take meds they cannot take that right
Please see my other answer on your other post.
I had a DUI in KY in 2012 and a second DUI in 2013 in GA where I reside. I have cleared everything with KY and done all my classes/treatments and now have a limited permit in GA once again. However, the limited permit has Class 0 Restrictions for work, court, probation, interlock provider only. Can I get it modified to take my children to doctor, school, etc? I am a divorced parent and need to be able to take them to these places. DDS in GA gives me a different answer each time I ask. Can someone help point me in the right direction? Thank you so much.
Unfortunately, you cannot. Your limited permit is set in stone and you cannot modify its conditions.
Just got charged last week for my first D.U.I and received the mandatory penalties. I got my license suspended for 1 year but was able to retain a restricted license. Believe it or not, I already did most of my D.U.I classes I had to do and paid all my fines. I heard that I can I can apply for my license reinstatement after 120 of my conviction. Is this true and would I need a lawyer to help me do this? Thank you.
At the end of the 120 days, as long as you have completed risk reduction (DUI school) you can go get reinstated. You...
MY BROTHER RECENTLY GOT A DUI IN GEORGIA AND BLEW A 0.09 WITH THE OFFICER ON THE ROADSIDE, HE THEN TOOK A BLOOD ALCOHOL TEST ONCE AT THE STATION. HE HAS SINCE REQUESTED THE POLICE REPORT AND BAC RESULTS AND WAS TOLD THEY WOULD NOT BE AVAILABLE UNTIL THE ACTUAL COURT DATE (2 MONTHS FROM NOW). IS THIS TRUE OR IS HE ABLE TO SEE THE RESULTS BEFORE THE COURT DATE? ANY HELP IS GREATLY APPRECIATED.
Yes, a criminal defendant has a right to examine any and all evidence that the State plans on using against him in a...
I am from GA and go to college in Mississippi. My license was revoked in Ms for 90 day by the court because of a dui. GA has a law about first time dui offence loss their license for a year. the 90 day suspension is almost up so I am planning to get a Ms license before the GA suspension kicks in. I have completed all that the courts in Ms ask me to. also how likely is it that my home state of GA will put the dui on my record since they haven't yet and it has been almost 90 days? thank you
If Mississippi reports the conviction to Georgia then Georgia will suspend your license here. I would wait a little...
