What to say when accused of a dui
I was driving home at night after having a couple beers and a deer ran out in front of my car. I had to swerve and my car became stuck in a ditch. I tried to push my car out but couldn't so someone driving by offered me a ride and I went home planning to get the car out the next morning. The car was towed by police overnight after someone called and said someone crashed their car and they saw he driver staggering. Now I have to call the cop who towed my car.
Do not make any statements to the police. If a significant number of hours have gone by it is likely you have no...
How can the judge sentence me a Conditional discharge for DWI-1st Offense and also a conviction?
Hello, The judge sentenced me to a DWI 1st-Offense conviction with a Speeding ticket very sadly 35/85(50 miles over the speed limit). I know that this speeding is not a criminal offense under New York Law. I was given a 3 year conditional discharge with a conviction, fine, installation of interlock device, attendance to a victim impact panel, seeing a therapist. Is the conditional discharge a suspended jail/prison sentence? I am thinking about immigrating to Australia and they deny anyones application who has served a 12 month or more jail/prison sentence in the past(Suspended sentences are counted as prison sentences). Is this 3 year conditional discharge a suspended jail/prison sentence?
A conditional discharge is not a suspended jail sentence. It is a set of requirements imposed by the court. It has...

I have a DWI with a 3 year conditional discharge and the court told me I was convicted. Is it a suspended/probated jail sentence
Hello, I got a DWI in NY and I got a 3 year conditional discharge along with victim impact panel, interlock installation to the car, counseling and a fine., I called and asked the court if I was convicted and they told me yes. I thought Conditional discharge would make the charges drop unless I commit another offence during the conditional discharge time period. I want to immigrate to Australia and they do not allow people who have been sentenced to 12 months or more in Jail or Prison and suspended sentences count as prison sentences . My question is does a 3 year conditional discharge count as a suspended sentence? That would make me automatically fail the immigration character requirements, thank you.
You were convicted of a misdemeanor. A conditional discharge is a sentence. Unfortunately, the conviction will stay...
I asked a question about trying to get your drivers license back if you have gotten 3 dwis in 25 years in NYS.
I have been convicted of 3 dui infraction in 25 years. my license has been suspended for 5 years. has any one in NYS gotten there license back. attorney say it is possible but no body can supply a case and just want $650 to just look at the information.
Only recently have the rules changed. DMV is not going to give your license back until the suspension has run. Once...

What should I expect from the DMV after being acquitted of a DWI?
Months back I was charged with a DWI and I have recently been acquitted of that charge. I'm going to the courthouse soon to obtain my certificate of disposition and head to the DMV after. What should I expect ? Will I get my license back that day? Will they still make me pay fees?
If you didn't refusal the chemical test (usually breath), you should be able to immediately get your full driving...
