Fifth Circuit Allows Texas Commission to Limit PURPA Sales

On September 8, 2014, the U.S. Court of Appeals for the Fifth Circuit dealt a blow to Exelon Corp. , rejecting challenges by various Exelon wind-generating entities to a Texas Public Utility Commission regulation and a 2009 PUCT order involving the sale of power from Qualifying Facilities 1 to a public utility under the Public Utilities Regulatory Policies Act . The Fifth Circuit's opinion raises important questions about the roles Congress gave to state and federal regulatory authorities to implement portions of PURPA.
