#1 The Federal Gov. would have had to have started the suit for it to be legitimate. Plaintiff Young America's Foundation lacks standing to bring suit.
#2 This was an act of the students, not the college itself. Thus the Solomon amendment does not apply here. That is why the case was decided in the favor of the school. |
