EPA investigating closed plant plagued by lawsuits, complaints
The federal government is investigating a shuttered waste recycling plant where a treatment pond caught fire three months ago.
Agents from the Environmental Protection Agency's criminal investigation division requested Jackson County's file on Agri-Cycle two weeks ago, county planning manager Frank Ethridge said.
An EPA spokeswoman declined comment on the matter.
Agri-Cycle was shut down in October after two years of operation when a judge ordered the company to stop accepting waste until it could prove it is not a threat to public health or safety. Talmo celebrates the Agri-Cycle ruling
After a week of considering all of the evidence put forth in the last EDP vs Agri-cycle hearing, Superior Court Judge David Motes ruled this morning to continue to prohibit Agri-Cycle from operating in Talmo.
Motes presented a seven page decision that included these highlights:
"For the reasons that follow (this is a seven page document) the court finds that the conduct of Agri-Cycle is more than a series of unfortunate events; their continued operation constitutes a clear and present danger to the citizens of Jackson County and the State of Georgia, and an injunction must be granted."
"For all of the above reasons (the seven page document), the court grants the injunction and prohibits Agri-Cycle from receiving waste for processing at its facility until the Defendant's appeal of an Administrative Order issued to it by the Director is ruled on by an Administrative Law Judge, or until Agri-Cycle can demonstrate to the Director or to the court that it can operate in accordance with the law and without posing a threat to human health, safety, and welfare, whichever even occurs first."
For now, the residents of Talmo and the surrounding are can breathe a bit easier and enjoy the Fall weather. No judge's ruling yet on Agri-Cycle request to re-open As of press time Wednesday, Superior Court Judge David Motes had not ruled in the Agri-Cycle case. via Jackson Herald
