Your article omits the actual facts that I was not repeatedly on any property, but made one fourty foot walk nothward from Hawthorne Avenue under power and telephone highwires where I have an easement relating to all possible utilities, my trip's purpose being to inspect what appeared to be beginning preparations for a bonfire; and by telephone I had reported same to the office of Jim Hamilton, manager of Westfield Electric Cooperative. Nor does your article state that Westfield Village Police Officer Barry Mellen was hostile and quite discourteous to me, refusing to look at both my deed and certified title search documents which would substantiate my having such easement. both my husband and i have dealt with local police on numerous occasions during both times we needed help and times in which we were in the wrong and none of them were hostile and discourteous. it seems that people who are treated with hostility by the police are usually giving attitude first. grow the hell up and quit bitching to a bunch of people who don't care. then again, keep complaining to this forum and have fun when all of the local cops will have you on their radar.

Perhaps the so-called "Jennifer" might one day grow up enough to be a bit less foul languaged and a bit more oriented to dealing in pertinent fact rather than inapposite emotional expressions which bespeak post midnight muddleheadedness induced by only-God-knows-what.

Why were you investigating what you thought to be a bonfire? If you had thought someone or some group of people were illegally on your land and making a bonfire, why did you not just call the police? Who did they police claim the land you were arrested for trespassing on belong to? You cannot be arrested for trespassing without a victim (in this case, the land owner). If the land that you were on is actually your property and you have documentation to back it up, then your case will be dismissed in court. I am not trying to pick an argument....I am just trying to understand what happened. If you have an easement for utilities that run through the land you were on, does that mean you yourself are legally allowed to occupy the land? I had always assumed that what this meant was that your utility lines were allowed to run through the land which is owned by another person or business. Was the land that the alleged bonfire your legal property, or was it just land that you had permission to run your utilities through? If it were the latter, then I can understand the arrest. Do you know what happened to the individuals who were having the bonfire?

Hello, "Michael"; and a proud Irish name it is. Preparation for a fire is not the actual setting of a fire. Prudence dictates heading off potential problems before such reaches harmful actuality. Easement rights regarding all possible utilities along the back property lines of all lots in a subdivision fall under developer's rights in the present case. Thinking in terms of individual lot ownership is an incorrect mindset for the present case.

Well, that's why I asked. With no experience in regards to easements (and all the wording involved) myself, i figured I would ask.

Ok, well thanks for hardly answering any questions. I was only asking because I was trying to gain an understanding on how things went wrong. So are you a developer working on the land? With the way you try to sound overly intelligent and evade answering the actual questions, I have no doubt that you gave the police officer a hard time.

Here's a novel idea..don't post your gripes on this webpage. There are a lot of trolls on here who will type goofy things to try to get you going. Also, if someone is actually trying to be nice to you and understand your situation, then just answer their questions without tip toeing around the answers.

My family's law enforcement history goes back to capture of the Younger Brothers' gang near Northfield, Minnesota before the turn of the Twentieth Century, and continues to this day. I know Barry can be a likeable fellow, but he'd never pass muster with any of my lawmen kin.

I am not asking for an education. I have two Bachelor's degrees and one Master's degree. I would eventually like to go on for my PhD, however it is not the easiest and most thoughtful thing for me to do right by having to uproot my family and move to another location. Neither of these degrees have to do with land ownership or guidelines for usage of easements. These things were the topic of original questions for you. Perhaps there was a misunderstanding, but when one posts a gripe on these types of forums, they tend to expect feedback. This is how I interpreted your post. I was trying to understand how such legal matters pertaining to land and easements works. I own the property my house is on, however do not have any easements (utility/road way), so I was just curious as to how they work. I guess what I am saying is that I was hoping for you explain these things in more of a laymen's terms for those of us who do not have this knowledge. By doing this, us readers could gain a better understanding and possibly offer helpful advice.

Real property law is quite complex, and it is very important for folks to understand that a conveyance of real property may include any lawful prohibition or allowance so long as such falls within the ownership rights of the grantor. Such codicils may be made to run with the land in perpetuity, or have limitations of endless variety so long as each limitation is lawful. This is why a buyer is wise to have a Certified Search of Title done by a highly competent and trustworthy person or entity. In the long run, it is in the best interest of a buyer to fully understand what she/he is getting for dollars paid.
